CITY COUNCIL WORK SESSION JANUARY 5, 2000 <br />Ms. Julie Schwartz came forward and stated the rink was built illegally with no permits. <br />If the vacation is allowed it is rewarding the violator. She stated the rink is obtrusive. <br />She indicated she has incurred hundreds of dollars in expenses for attorneys, surveyors, <br />etc. Because of the large discrepancy in the two (2) surveyor's, the City should be <br />required to obtain a third surveyor. It is possible that the rink is in violation of the <br />Shoreland Ordinance. She noted the letter from the Anoka Conservation District and the <br />recommendations from the Environmental Board are not included in the staff report. She <br />asked Council Members to read those items. <br />Ms. Schwartz continued stating the City is setting precedence if it allows the rink. There <br />are currently two (2) other rinks within the City. Approval would be opening the gate for <br />more rinks. She noted that other cities would never have let the issue get this far. She <br />stated the following outstanding issues have not been discussed in detail: <br />1. Lights and the easement area. <br />2. Swale design. <br />3. Future use of the easement and subdivisi <br />4. Changes in plat requirements. <br />Ms. Schwartz requested discussions be held i her property is needed. She also <br />requested a PE sign off on the swaleR t •t in the best interest of the City to <br />vacate the easement. Many tax do n spent because of a violator. Mr. Babacas will be holding a <br />press conference tomorrow regarding this issue. Mr. Babacas has a purchase agreement <br />with Mr. Rehbine for the purchase of his property for the proposed stadium. Staff <br />referred to a map indicating the location of the site. Mr. Babacas has requested a special <br />Council meeting to discuss the issue. <br />4 <br />
