Staff reviewed the <br />sed pool, and actual easement lines. <br />ac a - nt agreement, there is an ordinance issue. <br />uest. <br />Mr. O'Fallon, 647 fi Court, came forward and stated that he believes the City <br />ordinance pertains nd pools. He stated the sewer line is fairly new and will <br />outlive the life of th ool. He stated the pool can be taken apart in sections. He advised <br />he would remove the pool if the City needs access to the easement. He noted the pool is <br />not encroaching on the westerly easement. Approximately l of the pool would be on the <br />easement. The pool is 52" deep. Fencing is required and a privacy fence will be <br />installed. <br />Council Member O'Donnell inquired about another location for the pool. <br />Mr. O'Fallon stated he has an in -ground sprinkler system that would have to be excavated <br />to relocate the pool. Also, he would like the pool to be attached to his deck. <br />Council Member O'Donnell clarified that both an encroachment agreement and variance <br />would be needed to construct the pool. Staff advised the City may handle both at the <br />same time if the Council chooses to proceed. <br />
