CITY COUNCIL WORK SESSION MAY 17, 2000 <br />Council Member Carlson expressed concerns regarding setting a precedence if the <br />agreement is approved. She stated it is possible to place the pool in another location. <br />Council Member Reinert stated that use of the property is inhibited by the way it is sliced. <br />He stated he looks for some type of hardship when granting a variance. He stated he also <br />sees the City Engineer's point. <br />Council Member O'Donnell inquired about the time needed to dismantle the pool. <br />Mr. O'Fallon advised in emergency situations the pool could be drained within an hour. <br />He stated there is 20' of access on both sides of the pool. He noted the pool is not a <br />permanent structure. <br />Staff advised the full easement area would be needed if access is necessary. <br />Council Member Carlson noted the request does not meet the five -(5) necessary criteria <br />for granting a variance. <br />Staff noted the agreement would give the City the right to r v e ure if the <br />property owner was not present. Staff added there will b at' in the next <br />newsletter regarding City easements. <br />Council Member Carlson advised she agrees aff recommendation and cannot <br />support the easement encroachment a_ ce. <br />Council Member O'Donnell aees with the staff recommendation. He <br />noted the pool can be plac , :-rent`ocation. <br />Council Member R ; 3+ert` sed he is concerned about the variance. He stated he <br />wanted to support �`- ;:'��t encroachment agreement. <br />Acting Mayor Dahl ised she is concerned about emergency access. She stated it takes <br />too long to remove the structure. She added the property owner knew about the easement <br />when the property was purchased. She advised she agrees with the staff recommendation. <br />It was the consensus of Council that the staff recommendation will stand. <br />TOWERS PLAN, RICK DEGARDNER AND JEFF SMYSER <br />Staff distributed a memo regarding the background of PCS service facilities. Staff <br />recommended the City initiate a moratorium of new tower construction until a complete <br />tower location plan is completed. A moratorium for a reasonable time will not violate the <br />federal law, according to Mr. Strommen. <br />2 <br />
