• <br />• <br />• <br />COUNCIL MINUTES APRIL 9, 2001 <br />The City will relieve the Association of its obligations with respect to the Easement and <br />Option Agreement with the property owners at 6993 Black Duck Drive, and the Easement <br />Agreement with the property owners at 6998 Black Duck Drive. <br />The RPEHA will be responsible for any desired fencing along the proposed path. Board -on- <br />board fencing is prohibited within 20 feet of the property to be acquired. <br />Council Member O'Donnell asked when the trail will be developed. Public Services Director <br />DeGardner advised the trail will be developed in the next 90 days. <br />Council Member Carlson stated she thought there were more provisions in the original documents <br />relating to this issue. She suggested a statement be added relating to the previous provisions of the <br />Planning and Zoning Board and City Council. <br />Public Services Director stated he is not sure what provisions Council ber Carlson is referring to. <br />The agreement covers all issue of the City and the Homeowners A <br />Council Member Carlson asked if the current agreement cov <br />Planning and Zoning Board and City Council. This was a long process and the trail will <br />be an asset to the commu ity. <br />Motion carried unanimous <br />Resolution No. 01— 52 can be found in the City Clerk's office. <br />COMMUNITY DEVELOPMENT DEPARTMENT REPORT <br />There was no Community Development Department report. <br />UNFINISHED BUSINESS <br />March 12, 2001, Council Meeting Minutes - Council Member Reinert moved to approve the March <br />12, 2001, Council Meeting Minutes, as presented. Council Member O'Donnell seconded the motion. <br />Motion carried unanimously. <br />
