CITY COUNCIL WORK SESSION <br />AUGUST 22, 2001 <br />Mr. Roger Jensen, owner of the property, stated he carefully selected the lots and they <br />will be beautiful. The lots do meet the requirements and two (2) of them can not be <br />eliminated. <br />Council Member Dahl stated she is concerned about Lot 1 and Lot 8. She stated she <br />would like those lots to be taken care of. <br />Mayor Bergeson noted the plan is a legal proposal. Requiring a change not required by <br />the ordinance may have legal implications. <br />This item will appear on the regular Council agenda Monday, Aum 27, 2001, 6:30 p.m. <br />WEST SHADOW PONDS — POTENTIAL UTILITY ASSES MEN.- <br />RESIDENTS ON 62ND, COUNCIL MEMBER CARLSON tot <br />Council Member Carlson stated residents are concerned a ut1. count of property <br />they own on 62nd Street and possible assessments. <br />City Engineer Powell advised West Shadow Ponds can bserved from stubs on the north <br />side. The Council has indicated they will initiate t e r ction of 62nd Street. <br />Sanitary sewer and watermain will be consideow,• 62 St' eet when the improvements <br />are made. The Charter and 429 Statute will ply to ; , essments on properties on 62nd <br />Street similar to the Ware Road project. <br />City Engineer Powell stated construction osts and a staff recommendation will be made <br />after the feasibility study is compl e . ul c hearing will be held and residents can <br />petition out of the project. The Council determine how the project will be assessed if <br />it moves forward. He noted that'S ma ecommend sewer and water not be included <br />in the project. <br />Council Member Carlson r ferred to the Bisel Amendment and asked if it will apply. <br />City Engineer pwy referred esolution No. 98 —179, the modified Bisel. He stated <br />he believes the Rise 1 not apply in this case. He explained the appraisal <br />process used thatstipulates assessments can not be higher that the increased value to the <br />property. The City orney will be a part of the assessment process. <br />Council Member Carlson requested a general opinion from the City Attorney regarding <br />assessments of property owners who can not subdivide until 2010. She also inquired <br />about the City Charter. <br />City Engineer Powell advised residents can petition against the assessments but can't stop <br />the project. The City would then have to find another funding source to pay for the <br />project. The assessments would be paid if residents did hook up at some point in the <br />future. <br />6 <br />
