Approving this does not <br />follow the Planning and Zoning recommendation regarding the Rice Creek Watershed District. <br />Community Development Director Grochala stated staff was anticipating final plat approval in <br />October and the permits would have been issued by then. <br />Council Member Carlson stated she did vote yes two (2) weeks ago with the intent that these issues <br />would have been resolved. <br />Mayor Bergeson stated the items listed by Council Member Carlson don't make any difference. He <br />stated he believes Council Member Carlson just lost the Target project. The City will be required to <br />buy a severed parcel with no agreement and all of the taxpayers will have to pay for that. McDonalds <br />may be built but it is likely that the other businesses won't. Because of legislative changes which became <br />effective in August of 2001, a majority (3/5) vote was actually needed. The minutes of the <br />subsequent Council work session on September 5, 2001 and Council meeting on September 10, 2001 <br />further explain this action. When the legislative change was identified, the passage of this item <br />occurred as a default and the item was not formally reconsidered. <br />Mayor Bergeson excused himself from the meeting at 9:50 p.m. <br />Consider Resolution No. 01-119, Regarding Volker/Crenshaw Minor Subdivision and <br />Variance (3/5 Vote Required), Jeff Smyser — City Planner Smyser advised Mr. Volker has <br />submitted an application for a minor subdivision to split off the eastern portion of the property at <br />7080 Sunset Road.
