CITY COUNCIL WORK SESSION DECEMBER 12, 2001 CONSIDER OFF -SALE LIQUOR LICENSE REGULATIONS, ANN BLAIR City Clerk Blair distributed information regarding off -sale liquor licenses including a survey of other cities and questions the Council needs to answer in regard to regulating off -sale liquor licenses. The information also included a copy of the Blaine Code and a League of Minnesota matrix of licenses. She asked for direction from the Council regarding the regulation of liquor licenses. She stated there are currently seven (7) off - sale liquor licenses within the City noting the name of the establishment and type of license. Councilmember Reinert stated this issue needs to be addressed b regulate something that may not need to be regulated? He added look at who makes a living from the licenses. Councilmember O'Donnell asked if all the establishments on -sale licenses. Chief Pecchia stated the off -sale license scrutiny as the on -sale license holders. The establis are planning to have a retail store at some point in the compliance checks on all license holders. Councilmember Carlson stated the City is lik more development and the City should be p she would like to see some staff reco d ould the City City needs to ame scrutiny as under the same an off -sale license epartment is doing some restaurants come in with have a plan in place. She stated Mayor Bergeson stated there are man ' if p nt types of establishments and he is in favor of some type of regulation in the ®u * f rtor stores. Councilmember O'Donnell aske license if the City has a li license holders do not ne. City has a rational basis f ting license holders have a right to their of licenses. City Clerk Blair advised existing titlement to a renewal license, so long as the action it takes to deny a license. City Administra recommendation sed staff will do more research and bring a the Council. Councilmember O'Dell inquired about the type of zoning required for a liquor license. City Clerk Blair indicated she believes a liquor license can only be obtained in commercial zoning areas. She stated she would provide that information with the staff recommendation.
