COUNCIL MINUTES MARCH 11, 2002 Councilmember Carlson noted paragraph one of the proposed development agreement indicated the exclusive period shall continue, unless earlier terminated as provided herein, or until such later date as the parties may mutually agree. She requested confirmation that the term of the agreement is intended to be 90 days. Community Development Director Grochala stated this is correct, unless the parties decide to terminate the agreement earlier. City Attorney Hawkins noted the agreement could not be extended beyond 90 days unless mutually agreed to by the parties. Councilmember Carlson noted paragraph two of the agreement stated the site equals 42 (plus/minus) acres of land. She asked if this area included the City Hall. Final Plat for the development was approved in October of 2001 and included Outlot D and Outlot E. The two Outlots were intended to be combined with the remnant parcel created from the Apollo Drive right- of-way acquisition per the approved PDO Site Plan. 29
