CITY COUNCIL WORK SESSION SEPTEMBER 18, 2002 <br />• developer's agreement regarding that issue. However, the requirements that were noted <br />in the recent letter sent to builders are only implied. <br />• <br />Mr. Byron requested a copy of the developer's agreement. <br />Councilmember Dahl advised the houses in that area were supposed to be built as look <br />outs. The look out lots that were changed to walkouts may have caused the drainage <br />problems. <br />Community Development Director Grochala advised that sometimes homes are raised to <br />accommodate a walkout. <br />Councilmember Carlson read a letter from ARC regarding the water problems on the <br />McGuire property. The letter indicated the McGuire's are being advised to hire an <br />attorney to address the problem. She stated she does not understand why builders can <br />change plans midway through a project. She noted that she tried to look at the culvert on <br />Cripple Creek and it could not be seen. <br />7 <br />Community Development Director Grochala stated the Ci ' can not go back and right the <br />wrongs done in the past. The City does need to t , comprehensive view of where the <br />problems are and how they can be fixed. He suggeste . ving neighborhood meetings <br />and advised there will probably be a surface water Management project this year. The <br />question is who will pay for that project. The City intends to clean out on the culverts <br />this fall. <br />Councilmember Carlson stated the <br />developer's agreements to make <br />4s to look at the ordinances and the <br />y has recourse. <br />Mr. Byron advised he will obtain the rest of the signatures from residents and bring them <br />to City Hall on Monday. <br />City Engineer Studenski advised City funds will have to be used for this problem and <br />then later try to be reimbursed He added there are a lot of other areas within the City that <br />also have drainage problems. <br />Acting Mayor Reinert stated the City needs to have enough preparation time to conduct <br />the neighborhood meetings properly so this issue can be resolved. <br />Councilmember Dahl suggested the City Attorney draft a letter to send to the developers. <br />Community Development Director Grochala stated staff needs direction regarding the <br />letter to be sent to Mr. Hokanson regarding an ultimatum. <br />It was the consensus of Council to direct staff to draft a letter to send to Mr. Hokanson <br />• <br />requesting that he comply within ten days. <br />
