• <br />COUNCIL MINUTES SEPTEMBER 23, 2002 <br />Associate Planner Gretz stated that issue was raised by the Planning and Zoning Board but with <br />eleven acres if you increase the size of this to one acre, it reduces the remaining portion to less than <br />ten acres. <br />Mr. Lindahl stated they would be happy to make it a 1.5 acre lot with the remaining parcel to be 9.5 <br />acres. However, he wants to assure that a building permit would be allowed for a 9.5 acre lot. <br />Councilmember Dahl asked if a shared driveway arrangement would help. Mayor Bergeson stated <br />access is not an issue. <br />Mr. Lindahl stated Tract A (10 acres) has access from the street to the east without impacting the <br />other access. <br />Mayor Bergeson asked about the two previous approvals. Mayor Bergeson review e survey. <br />Councilmember Dahl asked if there is a <br />neighbor. <br />Mr. Lindahl stated five years ago wh - x. urcliased this property, it was the concept to keep the old <br />farmstead on one acre. He ode sure he had eleven acres which satisfied the City's <br />regulation and it was purchas a bas s that it could be done. He noted that the issue being <br />raised tonight was not raised at e Planning and Zoning Board meeting or when the neighbor down <br />the street got approval for less t 330 feet of frontage. <br />Councilmember Reinert asked if in ten years they want to do something, would they be <br />nonconforming or if a decision could be grandfathered to a decision made tonight. <br />urchase the additional area needed from the other <br />Mayor Bergeson stated if this is approved, it creates two lots of record, whatever size they would be. <br />Councilmember Reinert asked if the 9.5 acre lot would have limited use and if the alternative is to <br />make the one acre lot a little less to assure the remaining parcel is 10 acres and can be used. He asked <br />if this is a work session item that needs more discussion after staff looks it over and provides all the <br />information. He stated he does not think this was properly prepared for Council decision since the <br />right-of-way is a surprise issue just raised tonight. <br />25 <br />
