COUNCIL MINUTES SEPTEMBER 23, 2002 <br />These items were considered earlier in the meeting. <br />Consider Resolution No. 02-122, Accepting Drainage and Utility Easements, Lots 3-6, Lakes <br />Addition #2, Jeff Smyser - Community Development Director Grochala reviewed that Lakes <br />Addition #2 was platted in the 1980s. Subsequently, there was some legal activity regarding the <br />buildability of some of the lots in Lakes Addition #2 and Lakes Addition #3. In the end, among other <br />things, a separate drainage and utility easement covering portions of several lots was to be dedicated <br />to the City. This was to cover a wet area. However, this easement was never recorded. The City has <br />received a new easement grant document from the current owner, who has requested that the City <br />accept the easement to clear up the issue. Staff recommends the City accept this easement so it can be <br />recorded. <br />Community Development Director Grochala noted that as indicated on the attachments to Resolution <br />No. 02-122, the drainage and utility easement covers the eastertions of Lots 3-6. The resolution <br />states that the City Council accepts these easements. Once the re 1ut on is approved, the title <br />company will send the original deed for City signatures. <br />Councilmember Reinert moved to adopt Resolution No. 02- 2, Accepting Drainage and Utility <br />Easements, Lots 3-6, Lakes Addition No. 2. Councilmerri:erg seconded the motion. <br />Motion carried unanimously. <br />Resolution No. 02-122 can be found in the Ci 's ffice. <br />Consider Resolution No. 02-127, Accept nd Awarding Contract of Triplex Panel for <br />Lift Station #4, Jim Studenski — This p m onsidered earlier in the meeting. <br />Consider Resolution No. 02-129, ° ° i ibility Report, Calling for a Public Hearing, <br />Elm Street Reconstruction, Jim 'Rens i — is item was considered earlier in the meeting. <br />Consider Resolution No. 0 ` pt Feasibility Report, Calling for a Public Hearing, <br />62"d Street Reconstruction, Studenski — This item was considered earlier in the meeting. <br />Consider Resolutions No. 02-1 1, 02-132, 02-133, 02-134, 02-135, 02-136, Declaring Costs to be <br />Assessed and Order Preparation of Proposed Assessments, Jim Studenski — City Engineer <br />Studenski reported that four projects have progressed to the point where assessment rolls can be <br />prepared. Costs for each improvement have been calculated and resolutions prepared ordering the <br />preparation of the assessment roll. He noted developer projects to be assessed are for West Shadow <br />Ponds, Royal Pines, Clearwater Creek 5th Addition, and Lake Drive/Apollo Drive improvements. <br />City Engineer Studenski advised that several property owners who connected to City utilities this past <br />year have requested the assessments be collected with their taxes. <br />Councilmember Reinert moved to adopt Resolution No. 02-131, Declaring Costs to be Assessed and <br />Order Preparation of Proposed Assessments, West Shadow Ponds.
