COUNCIL MINUTES SEPTEMBER 23, 2002 <br />Lino Lakes is one of seven members in this franchise and the North Metro Telecommunication <br />Commission has renegotiated a cable television franchise on behalf of member cities with ATT <br />Broadband. As this franchise agreement is an ordinance, it requires a public hearing. She <br />recommended that public hearing be set for 6:45 p.m. on October 14, 2002 and noted that will also be <br />the first reading of the ordinance with the second reading scheduled on October 28, 2002. <br />City Administrator Waite Smith also recommended, because this is a lengthy document, that a <br />summary, prepared by the City Attorney, be published in lieu of the entire document. Staff's research <br />indicates this item is appropriate subject matter for the summary publication method. State law <br />provides for the summary publication alternative; however, it requires a 4/5ths vote of the Council to <br />do so. <br />Councilmember Reinert moved to schedule a public hearing on October 14, 2002 at 6:45 p.m. to <br />consider renewal of the Cable Communication Franchise Agrei t and first reading of Ordinance <br />No. 11-02. Councilmember Dahl seconded the motion. <br />Motion carried unanimously. <br />Councilmember Dahl moved to authorize summary publi tis Ordinance No. 11-02. <br />Councilmember Reinert seconded the motion. <br />Motion carried unanimously. <br />Consider Resolution No. 02-125, Acceptin <br />Equipment, Dan Tesch — Public Safety <br />Incorporated has graciously donated em <br />Safety Department. Councilmember Dahl seconded the motion. <br />Motion carried unanimously. <br />Resolution No. 02-125 can be found in the City Clerk's office. <br />Consider Resolution No. 02-95, Accepting Anoka County's Design for Reconstructing CSAH 49 <br />from Lake Drive to County Road J, Linda Waite Smith — City Administrator Waite Smith <br />advised in that in May or June, Anoka County stated they decided on the final design of <br />reconstruction of CSAH 49 south of Lake Drive to County Road J. Even though the City Council <br />was disappointed that Anoka County did not incorporate the suggestions made by the citizen's group <br />who conducted a lengthy process to review the plans, the City decided the project was so important to <br />the overall City, they would accept the design. She reviewed that a letter was sent to Anoka County <br />stating the City wanted the project done, and were willing to accept the compromise plan. Later the <br />City was advised that the letter would have carried more weight if accompanied by a formal <br />
