APPROVED COUNCIL MINUTES NOVEMBER 25, 2002 • Rezoning The Zoning Ordinance states that the Planning and Zoning Board and City Council shall consider possible adverse effects of the proposed amendment. Its judgment shall be based upon, but not limited to, the following factors: 1. The proposed action has been considered in relation to the specific policies and provisions of and has been found to be consistent with the official City Comprehensive Plan. The site is guided for commercial land use and subject to the conditions of site and building plan/conditional use permit approval the development is consistent with the Lino Lakes Comprehensive Plan. 2. The proposed use is or will be compatible with present and future land uses of the area. Subject to the conditions of site and building plan/conditional use permit approval the site is compatible with existing commercial and residential uses as well as future commercial and residential. 3. The proposed use conforms with all performance standards contained herein. • The proposed use conforms with all performance standards contained within the City's Zoning Ordinance. 4. The proposed use can be accommodated with existing public services and will not overburden the City's service capacity. Existing sanitary sewer and water services are available to the site and will not overburden existing public services. 5. Traffic generation by the proposed use is within capabilities of streets serving the property. The proposed development will assist with the improvement of the Birch/Hodgson intersection signalization. Conditional Use Permits The Zoning Ordinance states that the Planning and Zoning Board shall recommend a conditional use permit and the Council shall order the issuance of such permit only if it finds that such use at the proposed location: 1.
