APPROVED COUNCIL MINUTES DECEMBER 16, 2002 <br />• Environmental Specialist has indicated additional plantings can be provided on the four corners of the <br />property. Additional plantings can not be provided along the eastern property line. <br />• <br />Councilmember Carlson stated not having plantings on the east side of the property concerns her. <br />The letter from Anoka County seems to rule out any landscaping on that portion of the property. <br />Mr. Kirmis advised it is the City's perogative to approve the landscaping plan. The proposed plan <br />does not infringe on the site line as the County indicated in their letter. <br />Councilmember Carlson read comments from the School District regarding the landscaping issue. <br />She stated the School District is in favor of a buffer of trees between the properties. She advised she <br />is also in favor of a buffer of trees. She stated she would also like to see plantings on the east side but <br />does understand the safety issue. <br />Mr. Kirmus stated the County has asked for 20 feet of additional right-of-way but has no legal <br />authority to obtain it because this is not a subdivision. <br />Councilmember Carlson clarified that any additional right-of-way is not a part of this evening's <br />approval. <br />Community Development Director Grochala stated the City has no authority to require the dedication <br />of additional right-of-way. <br />Acting Mayor Reinert asked if Councilmember Carlson is recommending that a motion to approve the <br />plan include the buffering on the four corners and a buffer area on the school district property. <br />Councilmember Carlson indicated that is her recommendation. She asked if the applicant is agreeable <br />to that recommendation. <br />Mr. Derick Lashman came forward and stated he is concerned because he just reviewed the letter <br />from the County. He stated the applicant will work with the County and is willing to work with City <br />staff regarding the landscaping. <br />Community Development Director Grochala advised the date on the letter from the County is in error. <br />Staff met with the County last Tuesday and a letter was received last Wednesday. Typically the <br />County would request 60 feet of right-of-way. However, the City can not require the additional right- <br />of-way because this is not a subdivision. At some point in the future the County may have to acquire <br />the additional right-of-way. <br />Acting Mayor Reinert asked if not having the additional right-of-way will affect the right turn lane. <br />Community Development Director Grochala advised not having the additional right-of-way at this <br />point should not affect the right turn lane. <br />• Community Development Director Grochala continued indicating staff does have concern with the <br />trees on the school district site even though they have indicated they are agreeable.
