COUNCIL MINUTES JANUARY 27, 2003 <br />APPROVED <br />1 As a result, Associate Planner Gretz explained that staff is recommending approval of this vacation, <br />O' 2 but with a condition attached: A new survey of the lot has been done in an attempt to understand and <br />3 document site conditions. The survey has indicated an area to the west of the home, outside of the <br />4 easement area, that is below 902 feet, and thus within the 100 -year flood elevation. Due to this <br />5 condition, staff would recommend the following: <br />6 <br />7 1.) All portions of the lot outside of the drainage and utility easement which are below the 902 -foot <br />8 threshold elevation must be filled so that an elevation at or above 902 feet is achieved. A building <br />9 permit will not be issued until the City Engineer is satisfied that this condition has been met. <br />10 <br />11 Associate Planner Gretz indicated she could answer questions Council Members might have on this <br />12 issue, and stated that Mr. Vancil is here to answer any questions members have for him. <br />13 <br />14 Councilmember Carlson asked when the lots would be graded. Associate Planner Gretz indicated this <br />15 would be done at the time of construction. <br />16 <br />17 Councilmember Carlson indicated there are so many situations where grading plans are not followed, <br />18 she would like to see the regulations expanded so this does not happen so often in the future. <br />19 <br />20 Councilmember Dahl moved to approve FIRST READING of Ordinance No. 03-03, Vacating a <br />21 Portion of a Drainage and Utility Easement for Lot 2, Block 2, Pheasant Hills Preserve 4th Addition. <br />22 Councilmember Reinert seconded the motion. <br />23 <br />0 24 Councilmember Dahl voted yea. Councilmember Reinert voted yea. Councilmember Carlson voted <br />25 yea. Councilmember O'Donnell voted yea. Mayor Reinert voted yea. <br />26 <br />27 Motion carried unanimously. <br />28 <br />29 The City Clerk noted that a Roll Call was not completed for the Second Reading of Ordinance No. <br />30 02-03, Vacating Park Land, Pheasant Hills Preserve 9th Addition. Mayor Bergeson voted yea. <br />35 <br />36 Consideration of Resolution No. 03-11, Minor Subdivision and Variances, James Keefe, <br />37 Michael Grochala — This item was removed from the agenda. <br />38 <br />39 Community Development Director Grochala indicated that this item will come back before the <br />40 Council. He stated it is going to the Planning and Zoning Board on February 12, 2003. <br />41 <br />42 Consider Second Reading of Ordinance No. 01-03, Establishing Growth Management <br />43 Provisions, Jeff Smyser — City Planner Smyser advised that the Growth Management Ordinance, <br />44 Ordinance 01-03, is the first part of the package of ordinances that will implement the new <br />45 Comprehensive Plan. The Subdivision Ordinance and the Zoning Ordinance are the other two main <br />46 pieces of the package. The Planning & Zoning Board held a public hearing on Ordinance 01-03 on <br />ip47 January 8 and the Environmental Board heard it January 23. <br />48 <br />10 <br />
