COUNCIL MINUTES JANUARY 27, 2003 <br />APPROVED <br />1 <br />i2 Councilmember Carlson asked if the wording concerning the type of block could be added to the <br />3 conditions to formalize in writing the intent. Specifically it would say 'the proposed addition must be <br />4 constructed of rock faced block to match the existing building in terms of construction material and <br />5 height'. <br />6 <br />7 Councilmember O'Donnell asked for clarification, as the report indicates it was approved by the <br />8 Planning and Zoning Board by 1-4 vote. He asked if it was clear it was approved. He then corrected <br />9 his statement noting that it was approved with conditions 1 through 4. <br />10 <br />11 Councilmember Carlson moved to adopt Resolution No. 02-168, Approving a Site Plan Review for a <br />12 3,600 square foot Building Expansion for the UDOR Company (Apollo Business Park, Block 2, Lot <br />13 1) with the 9 conditions outlined by Staff and the 10th condition that the proposed addition be <br />14 constructed of rock faced block to match the existing building in terms of construction material and <br />15 height. Councilmember Reinert seconded the motion. <br />16 <br />17 Motion carried unanimously. <br />18 <br />19 Resolution No. 02-168 can be found in the City Clerk's office. <br />20 <br />21 PUBLIC HEARING — Consider First Reading of Ordinance No. 03-03, Vacating Drainage and <br />22 Utility Easements, Lot 2, Block 2, Pheasant Hills Preserve 4th Addition, Tanda Gretz — Associate <br />23 Planner Gretz advised that agenda item 7C is an application from Mr. Dale Vancil for the Vacation of <br />•24 a 295 -square foot area of a drainage and utility easement on his property, located at 1561 Merganser <br />25 Court, in the Pheasant Hills Preserve 4th Addition. The vacation is requested so that a home addition <br />26 and patio area can be constructed. <br />27 <br />28 Associate Planner Gretz indicated the need for a vacation came to light when Mr. Vancil went to pull <br />29 building permits and was advised that the proposed project area was within an easement area. Since <br />30 the proposed project area was covered by turf grass and did not appear to Mr. Vancil to be part of the <br />31 wetland which the easement was to protect, he contacted City Engineer Jim Studenski to pursue a <br />32 Vacation. <br />33 <br />34 Associate Planner Gretz noted that overall, the subject property is surrounded by similarly zoned and <br />35 guided properties, with properties to the east of it also containing large portions of their rear yards in <br />36 easement areas, which exist to protect a wetland to the north. The boundaries of the easement area on <br />37 the Vancil property — as shown on the Final Plat - are defined by the elevation of 902 feet, which is <br />38 the 100 -year flood elevation: thus, everything under 902 feet is under easement; everything at or <br />39 above 902 feet is outside the easement area. Grading on the lot, however, does not conform to <br />40 elevations shown on the Final Plat: there are areas within the easement area that are above the 902 <br />41 foot threshold, and area outside the easement area that are under the 902 foot threshold level. <br />42 <br />43 Most specifically, Associate Planner Gretz noted that the elevation of Mr. Vancil's proposed project <br />44 area is above the 902 feet threshold, even though it is shown on the final plat as existing within the <br />45 easement area. It is for this reason, that both City Engineer Jim Studenski and the Rice Creek <br />46 Watershed District have approved the Vacation of the easement area. <br />• 47 <br />9 <br />
