COUNCIL MINUTES JANUARY 27, 2003 <br />APPROVED <br />1 <br />• 2 A diagram has been provided to demonstrate easement requirements. (1007.9) <br />3 <br />4 A joint trench requirement for utilities has been added. This has been the City's practice, but it has <br />5 not been formally adopted by ordinance. (1007.10) <br />6 <br />7 Park Dedication: The City adopted new park dedication requirements in 2001. The new subdivision <br />8 ordinance includes these with no changes. It would be useful to review the park dedication fees at the <br />9 end of 2003 for possible increase. <br />10 <br />11 Tree Preservation: Section 1009 addresses the Tree Preservation requirements of subdividers. Item <br />12 3a on page 1009.2 requires the preparation of a tree inventory by a licensed professional to <br />13 encompass the entire property. In the Tree Replacement section on page 1009.4 Staff is proposing <br />14 the addition of the wording 'that was supposed to be saved but was' to paragraph 1 as outlined in <br />15 Attachment A. This will clarify an issue that has been difficult for developers and landowners to <br />16 understand. <br />17 <br />18 Improvements: Section 1010 lists elements of a new development that must be installed, and <br />19 mandates certain ones as the developer's responsibility. The new development agreement <br />20 requirements include a final grading survey to ensure that the grading plan was implemented by the <br />21 developer, which addresses the concern Councilmember Carlson raised earlier. Developers will not <br />22 be able to start building houses until grading plans are completed to specification. Based on previous <br />23 conversations the words 'and prior to approval of the final plat' will be removed from line one of <br />• <br />24 Section 1010.6. <br />25 <br />26 City Planner Smyser explained that much of the work in the last few months has focused on the <br />27 timing of the site work in relation to the preliminary and final plat approvals. In order to implement a <br />28 Growth Management Policy with restrictions on growth, it is necessary that the Subdivision <br />29 Ordinance strictly control what work occurs when. After discussion with the City Council at a work <br />30 session, staff revised the ordinance to reflect Council direction. <br />31 <br />32 City Planner Smyser noted that grading of the entire site can occur after preliminary plat approval, <br />33 with a development agreement that covers the grading. This agreement can include construction of <br />34 street, water, and sanitary sewer in the first phase. However, this construction cannot actually occur <br />35 until the first phase received final plat approval. Subsequent phases must then have additional <br />36 development agreements to address construction of streets, water, and sewer. <br />37 <br />38 Financial Security, Enforcement, Severability, Supremacy and Effective Date and Signatures: These <br />39 final sections refer to the policies and provide a brief overview. <br />40 <br />41 City Planner Smyser pointed out that the staff report contained pages that listed corrections to be <br />42 made as part of the approval of the first reading of the ordinance. Staff recommended the Council <br />43 approve the first reading of Ordinance 04-03, with the corrections listed on Attachment A. <br />44 <br />45 Councilmember O'Donnell asked if all comments from City Council and the Boards had been <br />46 considered and a clean copy would be provided for the second reading. City Planner Smyser <br />•47 indicated they had and a clean copy would be available. <br />48 <br />20 <br />
