COUNCIL MINUTES FEBRUARY 24, 2003 <br />APROVED <br />• 1 <br />2 Councilmember Reinert asked if that would be legal. City Attorney Hawkins offered his opinion that <br />3 it would be. <br />4 <br />5 City Planner Smyser noted at the beginning of the second sentence in Item g. language could be added <br />6 to say at 'City Council discretion'. He read the third sentence, adding he does not want to get into <br />7 this is what it will cost, who will pay and when. <br />8 <br />9 Mayor Bergeson stated it would be similar to an environmental impact study, ordered by the City <br />10 Council and used to make a decision. Councilmember Reinert stated that based on the timeframe, the <br />11 Council could approve if they were assured improvements would be made in a timely manner. <br />12 <br />13 Mayor Bergeson noted Councilmember Carlson had also suggested changes to Items d. and e., and he <br />14 confirmed there were no objections to those items. He added there was an addition of Item h., and the <br />15 City Attorney indicated that would be acceptable, again confirming there were no objections to this <br />16 addition. <br />17 <br />18 City Planner Smyser read Item g., with the changes suggested. Councilmember O'Donnell indicated <br />19 when talking about cost sharing, it would be good to add `and jurisdictions'. Councilmember Reinert <br />20 indicated it should probably say 'all properties', not `other properties'. City Planner Smyser stated he <br />21 would be worried about using `all', as two years from now everyone might not know and agree to <br />• 22 what that means like everyone does here today. Mayor Bergeson agreed, saying it could mean anyone <br />23 that wants to cross the road. <br />24 <br />25 Councilmember O'Donnell moved to approve SECOND READING of Ordinance No. 04-03, <br />26 Adopting Subdivision Regulations. Councilmember Reinert seconded the motion. <br />27 <br />28 Mayor Bergeson indicated they had only talked about one section of the ordinance, asking if there <br />29 were any comments on any other sections. <br />30 <br />31 Councilmember O'Donnell voted yea. Councilmember Reinert voted yea. Councilmember Carlson <br />32 voted yea. Councilmember Dahl voted yea. Mayor Bergeson voted yea. <br />33 <br />34 Ordinance 04-03 can be found in the City Clerk's office. <br />35 <br />36 City Planner Smyser indicated he would like to thank the task force, staff and the numerous boards <br />37 that reviewed and had input in this ordinance, stating a tremendous amount of work has gone into it <br />38 and they deserve credit for getting this done. <br />39 <br />40 ii) Consideration of Resolution No. 03-26 Approving the Summary of the <br />41 Subdivision Ordinance for Publication <br />42 <br />•43 City Planner Smyser advised that it is required that the City publish all ordinances, however because <br />44 this ordinance is lengthy, it would be costly to publish it in the newspaper. He stated it is allowed by <br />45 law for the City to publish a summary of an ordinance rather than the entire ordinance, however this <br />16 <br />
