COUNCIL MINUTES MARCH 24, 2003 <br />APPROVED <br />239 <br />•40 Mayor Bergeson indicated that it appears with a different design, the applicant could add the same <br />241 amount of square feet without requiring a variance. City Planner Smyser stated that was correct. He <br />242 indicated staff informed the applicant of this, however he rejected that option. <br />243 <br />244 Councilmember Reinert moved to approve Resolution No. 03-41 denying a variance for the <br />245 construction of a home addition 10 feet into the rear yard setback at 153 Parkview Drive, as outlined <br />246 by Staff. Councilmember Carlson seconded the motion. <br />247 <br />248 Councilmember Dahl indicated the Mayor brought up a good point. She asked, however, if the space <br />249 would have been useable in a different configuration, indicating 5 feet by 20 feet is not the same as 10 <br />250 feet by 10 feet in being useable. <br />251 <br />252 City Planner Smyser indicated the applicant could have up to a 20 foot addition rather than 30 feet. <br />253 <br />254 Mayor Bergeson stated it was important to note that this was also reviewed by the Planning and <br />255 Zoning Board, who also recommended denial. <br />256 <br />257 Motion carried unanimously. <br />258 <br />259 Resolution No. 03-41 can be found in the City Clerk's office. <br />260 <br />261 Consideration of Resolution 03-43, Approving Final Payment, Storm Water Cleaning, <br />. <br />62 Trapper's Crossing 2°d and 3rd Additions, Jim Studenski — City Engineer Studenski presented the <br />63 Staff report, adding City staff also cleaned a culvert that was questionable, which will now allow <br />264 them to monitor the situation to make sure it does not happen again. <br />265 <br />266 Councilmember Carlson asked if there was likely to be more clean-up at this location, and if so, <br />267 would the City be able to charge it back to the developer. City Engineer Studenski indicated this <br />268 property now had a clean slate, and the City now has the capability to track where it comes from in <br />269 case of future issues. <br />270 <br />271 Councilmember Dahl asked if this would take care of the rushing water around that area. City <br />272 Engineer Studenski indicated with the system cleaned, it should. He indicated the system met the <br />273 standards required, and he believes the issues have been addressed and it will be able to handle it <br />274 going forward. <br />275 <br />276 Councilmember Carlson moved to approve Resolution No. 03-43, Approving Final Payment for <br />277 Storm Sewer Cleaning, Trapper's Crossing 2nd and 3rd Addition to Infratech.
