Consideration of First Reading of Ordinance No. 11-03, Amending permitted hours of <br />243 construction set forth in City Code, Jeff Smyser <br />244 <br />245 City Planner Smyser summarized the staff report, reviewing the proposed changes to the ordinance, <br />246 and indicating staff recommends approval of the first reading. <br />247 <br />248 Councilmember Carlson stated this is an ordinance that deals with noise, and originally covered <br />249 people working on their own homes, but now it does not cover them at all. She indicated whether a <br />250 builder or an individual, construction noise can be irritating to neighbors, and asked if it was wise to <br />251 take off Section 4b of the previous wording entirely. She stated it appears there should be some <br />252 restriction on individuals also. <br />253 <br />254 City Planner Smyser stated that the way it is written it would not allow someone to build a new <br />255 house, whether individual or contractor. He indicated individual homeowners who work during the <br />256 day often like to work on their homes on evenings or weekends, and they were trying to go for scale, <br />257 targeting larger projects. <br />258 <br />259 Councilmember Carlson indicated she thought of that as well, but there is work that can be done late <br />260 at night without disturbing the neighbors, while some outside work could be very irritating. <br />261 <br />262 Councilmember O'Donnell agreed, and thinks this needs some pushing around. He would suggest <br />. <br />63 tabling it and discussing at the work session. <br />64 <br />265 Mayor Bergeson asked if there was any urgency. He stated another option is to approve the first <br />266 reading and tweak it before the second reading. <br />267 <br />268 Councilmember Carlson indicated another point is no construction on Sundays or Federal Holidays; <br />269 she wondered if that could say the stated construction activities are not allowed on those days. She <br />270 agreed that if there is no urgency, it would be best to bring it back to a work session. <br />271 <br />272 Councilmember Carlson moved to table the FIRST READING of Ordinance No. 11-03 amending <br />273 Section 900 of the City Code relating to nuisances: Permitted hours of construction activity. <br />274 Councilmember Dahl seconded the motion. <br />275 <br />276 Motion carried unanimously. <br />277 <br />278 B. Public Hearing, Consideration of Resolution No. 03-44, Eagle Brook Church EAW, <br />279 Declaration on need for EIS <br />280 <br />281 Mayor Bergeson explained that three weeks ago there was an article in the Quad paper about this <br />282 subject, and there will be a public meeting here tonight. He advised he would provide background on <br />283 the issue, and then there would be public comments, followed by some action by the City Council. <br />284 He asked that everyone be brief and courteous. <br />285 <br />186 Mayor Bergeson relayed that an Environmental Assessment Worksheet (EAW) was prepared for the <br />87 Eagle Brook Church, and has undergone public review.
