CITY COUNCIL WORK SESSION JUNE 4, 2003 <br />APPROVED <br />district because of the significant road improvements that will be necessary on that site <br />• when development occurs. <br />• <br />KELLER VARIANCE, 6206 RED MAPLE LANE, MICHAEL GROCHALA <br />Community Development Director Grochala advised this issue was discussed at the last <br />Council meeting. <br />Mrs. Keller distributed a letter outlining the reason for the variance request. The letter <br />also noted concerns with the City process and rules regarding variance requests. <br />Community Development Director Grochala advised the staff report did include the <br />recommendation for approval from the Planning and Zoning Board. He referred to the <br />Findings of Fact and setback requirements indicating why staff is recommending denial. <br />He read a letter from the City Attorney recommending a condition of approval in regard <br />to the right-of-way. <br />Community Development Director Grochala stated staff is very concerned about the <br />proposed location of the septic system. He read a letter from the installer of the system <br />that indicated a portion of the dike would be in the right-of-way. Therefore, another <br />variance would be necessary. <br />Mrs. Keller stated the current system is not failing but does need to be upgraded. <br />Community Development Director Grochala stated he would be reviewing the location of <br />the septic system with Pete Kluegel tomorrow. The house variance is a non -issue until <br />the septic design issues are resolved. Staff will have a recommendation in the Friday <br />update. The septic variance and house variance are two separate issues. Council can <br />grant the house variance. The applicant will then have to design a septic system that <br />meets all City requirements. <br />This item will appear on the regular Council agenda Monday, June 9, 2003, 7:30 p.m. <br />DRAINAGE ISSUES AT 6514 WHITE OAK LANE, MICHAEL GROCHALA, <br />JIM STUDENSKI <br />Community Development Director Grochala advised the drainage at this site has been an <br />ongoing issue for at least a year. The resident has a transite heating system that is filling <br />up with water. There were ongoing drainage issues with the property. Last fall staff <br />rebuilt the drain tile. The resident believes poor drainage caused his water problems. <br />Staff viewed the property on Tuesday. The heating system is actually lower than some of <br />the drain tile. The resident is requested the City pay for new drain tile and moving the <br />sump pump. Staff does not believe that the City bears responsibility for the water <br />problems. <br />Community Development Director Grochala advised the City Attorney has been very <br />clear about the City not being responsible. The resident has indicated he is going to <br />pursue legal action against the City. <br />
