He indicated there is not data right now concerning how it will hold up with plowing. <br />195 <br />196 Councilmember Reinert moved to adopt Resolution No. 03-115 approving a Conditional Use Permit <br />197 for Discount Tire with the following conditions: <br />198 <br />199 1. Revised Plans shall be submitted incorporating the following items: <br />200 a. The Landscaping Plan be modified to replace the proposed Colorado Green Spruce <br />201 trees with Black Hills Spruce. <br />202 b. The wall -mounted lights contain a cutoff which directs and cuts off the light at an <br />203 angle of ninety (90) degrees. <br />204 c. The modifications and comments as set forth in the City Engineer's memo, dated June <br />205 27, 2003, shall be incorporated into the plans. <br />206 d. The trash receptacle area shall be completely enclosed. Such enclosure shall be <br />207 constructed with materials matching the principal building. <br />208 2. The Conditional Use Permit shall be limited to uses classified as Automobile Repair — Minor <br />209 defined in Section 1, Subd. 2 of the Lino Lakes Zoning Ordinance as an establishment <br />210 providing goods or services related to automobiles such as car washes, repair businesses <br />211 limited to minor engine repair, fluid changing, tire service and muffler repair and other uses of <br />212 similar character, but not including uses defined as a major automobile business or automobile <br />213 sales. <br />214 3. The emission of odor by a use shall be in compliance with and regulated by the State of <br />215 Minnesota Pollution Control Standards, Minnesota regulations APC, as amended. <br />yr 16 4. All flammable materials, including liquids and rags, shall conform with the applicable <br />217 provisions of the Minnesota Uniform Fire Code. <br />218 5. All outside storage shall be prohibited except the storage of customer vehicles waiting for <br />219 repair. <br />220 6. All conditions pertaining to a specific site are subject to change when the Council, upon <br />221 investigation in relation to a formal request, finds that the general welfare and public <br />222 betterment can be served by modifying the conditions. <br />223 7. Consideration of Resolution No. 03-116, Approving Plans and Specifications and <br />232 Authorizing Advertisement for Bids, 21st Avenue Street Construction, Jim Studenski <br />233 <br />234 City Engineer Jim Studenski presented the staff report. He advised this street is in very poor <br />235 condition, and the project will improve the street along with providing installation of storm sewer. <br />236 He noted currently there are minimal ditches and there are drainage issues which have contributed to <br />237 the deterioration of the road. He stated three properties have signed on with the project, and advised <br />mii238 Centerville will be going through the same process.
