COUNCIL MINUTES SEPTEMBER 8, 2003 <br />APPROVED <br />620 Councilmember O'Donnell stated he thinks restricting the number of cars may also be needed to <br />.21 control the appearance of the site. He pointed out that this may be difficult to enforce. <br />622 <br />623 Mayor Bergeson suggested that this concern be noted and staff be asked to work with the developer to <br />624 draft language to address that concern. <br />625 <br />626 Councilmember Reinert noted this language will not be needed unless a problem occurs and <br />627 enforcement action is needed. He agreed with the suggestion to have staff and the developer draft <br />628 appropriate language including no more than four vehicles or 48 continuous hours. <br />629 <br />630 Mayor Bergeson stated that parapets are nice on larger -sized buildings where the back cannot be <br />631 viewed. But with angled lots and buildings, you can see the back of the parapet so he is not sure it <br />632 adds to the quality of the design. He suggested staff and the developer look at other options. <br />633 <br />634 Community Development Director Grochala explained that was added to make the building a better <br />635 fit with the Target building. He stated staff will work with Mr. Baylor on that detail and with the City <br />636 Attorney on the outdoor parking language. <br />637 <br />638 Councilmember Dahl stated her support for the language suggested by Councilmember Reinert of no <br />639 more than four cars or 48 hours. <br />640 <br />641 Councilmember Carlson noted a discrepancy in the number of conditions between the staff report and <br />642 draft resolution. Community Development Director Grochala explained that Conditions #7 and #8 in <br />643 the draft resolution are new conditions and refer to the Rice Creek Watershed District and Mn/DOT <br />W44 permits. They were not part of the staff report. <br />645 <br />646 Councilmember Reinert asked about the specific designation of "automobile and truck repair." <br />647 Community Development Director Grochala stated that is the definition contained in the code and <br />648 would not include repair of semi -trucks. <br />649 <br />650 Councilmember Carlson moved to adopt Resolution No. 03-151, Approving Conditional Use Permit, <br />651 Automobile and Truck Repair, JADT Development, as amended to include 15 conditions as modified. <br />652 Councilmember Dahl seconded the motion. <br />653 <br />654 Motion carried unanimously. <br />655 <br />656 Resolution No. 03-151 can be found in the City Clerk's office. <br />657 <br />658 E.
