COUNCIL MINUTES OCTOBER 13, 2003 <br />APPROVED <br />•503 Mr. Kinghorn stated if the bids exceed the estimate by 10% they cannot proceed. He asked if the <br />504 City would have to go out for another referendum. City Attorney Hawkins indicated if the bid <br />505 exceeds the estimate by 10% they cannot award the bid and if they cannot fund it, they would have to <br />506 go back for a referendum. Mr. Kinghorn stated he believes that what they are saying, in essence, is <br />507 that if the plan (which he feels he has had no input on) goes over the estimate, he cannot have trails. <br />508 City Attorney Hawkins indicated what they are saying is everyone gets a road in front of their house. <br />509 He stated if a neighborhood wants more, they have to pay 100% of those costs. Mr. Kinghorn asked <br />510 how the Elm Creek neighborhood got sidewalks. Community Development Director Grochala <br />511 explained the City has a park and trail plan that included the Elm Creek neighborhood. <br />512 <br />513 Mr. Kinghorn indicated if they are going to put a street in they should consider not putting it in <br />514 without City sewer and water. He also asked what they would do about access during the <br />515 construction. City Engineer Studenski advised they are here discussing the street construction. He <br />516 stated they have been in contact with the golf course on access from the north end, and as they get <br />517 into the plan they will have more specifics. He indicated as for the utilities they know it will be <br />518 difficult with the long cul-de-sac, and Staff will have to look at depths and the logistics of bringing <br />519 utilities in. <br />520 <br />521 Mr. Kinghorn stated regarding drainage, the report says land may have to be acquired to do that. He <br />522 asked if Staff knew whose property would be acquired. City Engineer Studenski stated they did not <br />523 know at this time. They will have to work through the drainage as part of the development plan, but <br />524 there are no specific lots that have been targeted. Mr. Kinghorn indicated he wants to make sure the <br />•525 homeowners are part of the planning process and have a voice in determining what happens on their <br />526 street. <br />527 <br />528 Jason LaPlante, 6889 West Shadow Lake Drive stated he is not completely opposed to the project, <br />529 but from an engineering standpoint, he believes it is a million dollar solution to a thousand dollar <br />530 problem. He stated they will have a 28 -foot road when a one -lane dead-end has been fine. He <br />531 indicated he has lived there a long time and has never had a problem with the 23 -foot road. He asked <br />532 why they could not put a 24 -foot concrete overlay onto the road that is there. <br />533 <br />534 City Engineer Studenski stated as far as the street width, the City standard for residential roads is 32 <br />535 feet. They have already looked at making an adjustment for the character of the area so they have <br />536 reduced that to 28 feet. He stated they have emergency vehicle issues and parking issues. He is glad <br />537 to hear there are no problems with the narrow road, but Staff also gets calls asking why the City <br />538 allows a sub -standard road. He indicated as to putting some kind of covering over what is there, the <br />539 street is not to any standard now. He stated they will have varying design criteria of what is needed <br />540 and differences in sub -grade, all of which has not been fully determined. <br />541 <br />542 Mr. LaPlante indicated he would still contend a concrete road would be acceptable. He stated the <br />543 road has not suffered any severe deterioration since he has lived there. He indicated the report says it <br />544 would be a 10 -year road because there is no curb and gutter, but he has been there 30 years with little <br />545 deterioration. He indicated concrete would work, and he would like to discuss it further with staff. <br />546 He stated he is also curious about drainage, as his property serves as a pond now, and he is curious <br />.47 where the added land will come from.
