COUNCIL MINUTES OCTOBER 13, 2003 <br />APPROVED <br />549 Mike Trehus, 675 Shadow Court indicated the City Charter says the resolution will state the scope <br />550 and number of benefitted property owners. He asked when that information will be available. <br />551 Community Development Director Grochala indicated there are 136 owners for both projects. Mr. <br />552 Trehus asked if the projects were being treated together so one neighborhood could kill the other. <br />553 Community Development Director Grochala stated he would recommend they be handled separately. <br />554 They would need to determine the exact number for each project, and 50% or more are needed to <br />555 petition against the project. Mr. Trehus stated the number was not part of the information sent to <br />556 homeowners. City Attorney Hawkins stated Staff could get the numbers for him. City Engineer <br />557 Studenski indicated there are 65 on Shenandoah and 71 on West Shadow Lake. Community <br />558 Development Director Grochala advised one property on West Shadow Lake has 17 owners, so the <br />559 number for that project would be 70 plus 17. <br />560 <br />561 Mr. LaPlante stated there are 17 owners that co-own one lot. He asked if they would each be <br />562 assessed $3150. Community Development Director Grochala indicated they would be assessed 1/17th <br />563 of $3150. <br />564 <br />565 Mr. Trehus stated he is scared by the project. He indicated in reading the feasibility study that was <br />566 circulated by his neighbor, he realizes how in the dark he is. He stated it says `needs additional <br />567 review'; `considerable extra time'; `assess during construction'; 'a more detailed geotechnical report <br />568 is recommended'; `easements may be needed for storm swater and drainage design'. He indicated <br />569 there are a lot of undetermined things in this feasibility study. Councilmember Reinert indicated to <br />570 take a project like this and answer every question residents would like to see is not prudent for the <br />• <br />571 City. It takes a lot of money for plans detailed to that degree and to spend that money and have it fail <br />572 in the voting booth would not be prudent. Mr. Trehus stated he understands, but as of now he does <br />573 not know if he will have a pond across the street or what will happen. He does not know if easements <br />574 will be taken from his property. <br />575 <br />576 Councilmember Reinert indicated what they are asking in November is for all the residents of Lino <br />577 Lakes to vote to improve a portion of the 99 miles of roadway. Mr. Trehus commented that they do <br />578 not know how it will affect them. He indicated that to go ahead with the street without sewer and <br />579 water would lock them out for another 20 years. He believes the City is going about this the wrong <br />580 way. He believes the process should take place as laid out in the City Charter. He stated if residents <br />581 vote and then the project does not go through, the residents will wonder what the City is doing. He <br />582 stated in their area, it makes sense to have a rural road, but the point is those questions would be <br />583 better worked out first. He indicated discussions with the residents would be a good idea. <br />584 <br />585 Joey Skaswald indicated he owns 800 feet of low land and the lot he lives on. He stated the City <br />586 Council should table this and have the engineers come up with a preliminary plan. He stated the <br />587 question is on utilities. Sewer is only a few years away, and it seems silly to put the street in and <br />588 come back and put sewer in later. Community Development Director Grochala stated it would be <br />589 their intention not to do that. He indicated with sewer and water they would prefer to do it now, but <br />590 if the referendum passes it would be up to the residents to determine if sewer and water goes in. <br />591 <br />592 Mr. Skaswald stated the road has not been sealed in 25 years. Community Development Director <br />093 Grochala indicated it was sealed in 2002. Mr. Skaswald disagreed, indicating it was patched only. <br />13 <br />
