COUNCIL MINUTES OCTOBER 13, 2003 <br />APPROVED <br />•229 City Engineer Studenski indicated the delays have been two -fold. Because this street goes down the <br />230 boundary of Centerville and Lino Lakes they had to work through boundary issues. He indicated the <br />231 costs have been high, and they ended up going back to redesign the project, at which time they had to <br />232 re -submit to both cities and hold additional hearings. He stated they had to set up a Joint Powers <br />233 agreement as well. He noted it took them until last fall to get that far, then they had to get approvals <br />234 from the Rice Creek Watershed District. He indicated Staff does not feel the degradation was just <br />235 from the delay of the last few years. He stated the City has tried to take corrective measures with the <br />236 street but they have not held up so there are many corrective measures to take now. <br />237 <br />238 Mr. Bourassa indicated they would like the opportunity to review the inspection documents to see <br />239 what was built up. Mayor Bergeson stated those would be public records so there is no problem with <br />240 making them available for review. <br />241 <br />242 Mr. Bourassa stated the second clarification is on the assessment calculation. He indicated he <br />243 understands the assessment was calculated on Outlot A also, and questioned if they are being <br />244 assessed, why the roadway is not constructed to the end of the property. City Engineer Studenski <br />245 stated that again, it is one of the cost-saving measures. He indicated the road is benefitting Outlot A <br />246 but as a cost saving measure they pulled the road back. He stated they could review that again. Mr. <br />247 Bourassa stated their position would be that if they are being assessed for that lot they would like a <br />248 roadway. <br />249 <br />250 Tom Rudy, Mr. Rehbein's attorney stated he could speak to the issue of the sewer line that was put <br />•251 in. He indicated it was oversized at the request of the City. He indicated when Dairy Queen went in, <br />252 it was approximately a $670,000 job. The sewer line was put in under Main Street, and constructed <br />253 to City standards and under City inspection. <br />254 <br />255 Joan Tschida, Clearwater Creek Convenience Center, indicated she objects to the project, and feels <br />256 $81,000 for her parcel of land is horrendous. She does not see how it adds $81,000 of value to the <br />257 property, and she has reserved her right to litigate. She was promised a road in 1998, and met with <br />258 both City Councils at that time. She stated if the road had been done then it would not cost this much <br />259 now. <br />260 <br />261 A representative of the owners of the Dairy Queen property spoke, and indicated the businesscame in <br />262 during 2000, at which time they had a blacktop road. He stated one time last spring there was a foot <br />263 and a half of water on the road, and his customers were going elsewhere. He believes the City <br />264 received good bids. He stated the road has been allowed to deteriorate and cannot go further. He <br />265 stated he believes that saying his business does not suffer is ludicrous. He stated the Council can say <br />266 it is a Centerville road, but Lino Lakes collects his property taxes and it is time to vote and get this <br />267 road done. <br />268 <br />269 James Kozar stated he is across the street. He indicated his understanding is they will elevate the <br />270 road, and asked for further explanation. City Engineer Studenski stated regarding Main Street there <br />271 are no specific plans to elevate, but Anoka County is starting their process. He indicated Anoka <br />272 County is proposing the road be pushed north to mitigate impact, but the amount they will raise the <br />073 road is unknown. <br />274 <br />
