COUNCIL MINUTES OCTOBER 13, 2003 <br />APPROVED <br />.275 Mr. Kozar stated as for the assessment, his started at $24,000, went up to $30,000, then dropped to <br />276 $14,000. He noted across the street it seems quite high. He indicated if they were to elevate the road, <br />277 his customers will not have access to his business or to the other businesses that were objecting. He <br />278 asked where they could get information on what Anoka County is doing. Community Development <br />279 Director Grochala noted that Anoka County will be doing their Main Street project, slated for 2005 or <br />280 2006. They are in the process of evaluating now, and regardless of what height the road becomes, <br />281 they will still have to provide access to the businesses along Main Street. He indicated the question <br />282 is only the grade and how the road will be laid out. He stated it will probably be a year or more <br />283 before they know what the bridge impact will be. <br />284 <br />285 Mr. Kozar asked if they would get information ahead of time. Community Development Director <br />286 Grochala stated the owners will be notified and will go through a similar process as this one. <br />287 <br />288 Mr. Kozar commented he watched Mr. Rehbein do the road and verified that he already cut down two <br />289 feet. <br />290 <br />291 There was no one else present who wished to speak. Councilmember Dahl moved to close the public <br />292 hearing. Councilmember Carlson seconded the motion. Motion carried unanimously. <br />293 <br />294 Mayor Bergeson indicated they have had several objections, and have two options. They can adopt <br />295 the assessment roll and let the various parties follow the process to pursue legal action or they can <br />296 delay action this evening. <br />• 297 <br />298 City Attorney Hawkins indicated the Mayor outlined the options clearly. He stated it is incumbent on <br />299 the City Council to determine if the assessments add enough value to the property. He indicated the <br />300 assessments must increase the value by at least as much as the assessment, and the City Council <br />301 heard statements that it does not. He stated Staff is not in a position to verify that tonight one way or <br />302 another, so the Council may want to send it back for Staff to review. <br />303 <br />304 Community Development Director Grochala indicated the only timeline concern is on awarding the <br />305 contract. He felt there was time to review. He noted the issue with this project since 1996 has been <br />306 cost, and they have gone through many iterations. He stated it is apparent the property owners still <br />307 find the costs too high. Staff can go back and see what options they have and present the information <br />308 at a work session, but they have to award the contract by October 27, 2003 or deny the bids. <br />309 <br />310 City Engineer Studenski indicated they will also have to go back to the contractor on the timeline for <br />311 the season, and see if it is too late and some of the project will have to be done in the spring. Mayor <br />312 Bergeson asked if this was scheduled to still be completed this fall. City Engineer Studenski <br />313 indicated that was correct. <br />314 <br />315 Councilmember Reinert stated they have to get this project done; it has already been put off too long. <br />316 However, he indicated they have heard opposition. He stated Staff has said there may be some <br />317 options. He asked if they could move forward with this while examining other options. Community <br />318 Development Director Grochala stated he would want to determine options before they move <br />•19 forward. Mayor Bergeson added he would prefer to review it at a work session and bring it back for <br />320 action at the next meeting. <br />
