COUNCIL MINUTES APRIL 12, 2004 <br />APPROVED <br />1 There was none. <br />• 2 <br />3 ADMINISTRATION DEPARTMENT REPORT, DAN TESCH <br />4 <br />5 A. Public Hearing, Consider SECOND READING of Ordinance No. 05-04, Amending <br />6 Liquor Code Relating to Strong Beer, Ann Blair <br />7 <br />8 City Clerk Blair reported Section 700 of the City Code relating to Liquor and Beer Licensing was last <br />9 updated in 2002, and in reviewing the Code from some legislative changes, will be bringing forward <br />10 a recommendation for a few updates in this area. <br />11 <br />12 City Clerk Blair stated the Council approved a wine and 3.2% beer license for Mansetti's Pizza at the <br />13 February 9, 2004 meeting. She stated that Minn. Stat. 340A.404, subd. 5 provides that a City may <br />14 allow the sale of strong beer at an on -sale establishment that already has a wine and a 3.2% beer <br />15 license without any additional license, subject to the condition that the receipts must be at least 60 <br />16 percent attributable to sale of food. <br />17 <br />18 City Clerk Blair stated she spoke with the City Attorney, who stated the Code as drafted does not <br />19 allow this, but that the City may clearly do so, so this was brought forward and received a first <br />20 reading. <br />21 <br />22 City Clerk Blair requested the Council hold a public hearing on this item and consider a second <br />23 reading of Ordinance No. 05-04. <br />24 <br />• 25 Mayor Bergeson opened the public hearing at 6:43 p.m. <br />26 <br />27 There were no public comments. <br />28 <br />29 Councilmember Dahl moved to close the public hearing at 6:43 p.m. Councilmember Reinert <br />30 seconded the motion. <br />31 <br />32 Motion carried unanimously. <br />33 <br />34 Councilmember Carlson moved to approve the SECOND READING and adopt Ordinance No. 05-04, <br />35 Amending the City Code, Section 700 of the Liquor Code, by adding the section relating to sale of <br />36 strong beer in conjunction with wine and 3.2 sales. Councilmember Dahl seconded the motion. <br />37 <br />38 Vote: 4 — 0. Councilmember Carlson voted yea. Councilmember Dahl voted yea. Councilmember <br />39 Reinert voted yea. Mayor Reinert voted yea. Councilmember Stoltz was absent. <br />40 <br />41 Motion carried unanimously. <br />42 <br />43 Ordinance No. 05-04 can be found in the City Clerk's office, and will become effective 30 days <br />44 following publication. <br />45 <br />46 B.
