COUNCIL MINUTES APRIL 12, 2004 <br />APPROVED <br />1 Councilmember Dahl stated the Comprehensive Plan is supposed to be reviewed annually, and it <br />• 2 hasn't been done, and she would like someone from staff to follow up on that. <br />3 <br />4 Councilmember Dahl requested Mr. Uhde to address the Council. <br />5 <br />6 Mr. Uhde addressed the Council, stating that they had been very proactive in trying to get an end to <br />7 this because they couldn't leave the letters of credit in place forever, so they were trying to get a <br />8 number that made sense. He stated there had been a traffic study, and the number of $7,000 or $8,000 <br />9 was come up with for the increase in traffic caused by their development. He stated the original offer <br />10 was $14,000 or $15,000. He stated he had wanted to get the letter of credit released, so he had made <br />11 the offer of $25,500 and would have written a check that day, but he was asked not to, and he was <br />12 told there needed to be further research. He stated that in any event, he is willing to stand by that <br />13 offer today and would have the check to them tomorrow. <br />14 <br />15 Councilmember Carlson stated she wanted to be sure that there are not any safety issues with the <br />16 airplanes from the people that would be landing and taking off with the planes, and she wanted to <br />17 hear from someone from the Air Park. <br />18 <br />19 Mr. Dave Hunter, President of the Air Park Association, addressed the Council, saying that they were <br />20 comfortable with the redefinition of the restrictions in terms of heights of buildings. <br />21 <br />22 Councilmember Carlson stated she is going to abstain from voting on the issue because of lack of <br />23 information that she had requested prior to the work session. <br />24 <br />25 City Planner Smyser stated the developer would like approval so that he can start selling the lots and <br />26 building them. <br />27 <br />28 City Attorney Sullivan stated there is a limit to the amount of dedications a city can require or extract <br />29 from developers. He stated that many cities have ordinances saying 10 percent or some flat fee. He <br />30 stated that it is supposed to be a proportionate amount. He stated he assumes when this was done a <br />31 year ago, that the city, staff, and Mr. Hawkins determined that this was a proportionate amount. <br />32 Councilmember Dahl asked if there were figures on how much the trails are going to cost to <br />33 construct. She also asked if they were going to be paved. <br />34 <br />35 City Planner Smyser indicated that some of the trails are eight -foot asphalt and some are five-foot <br />36 sidewalks. <br />37 <br />38 Councilmember Dahl stated there would be no money to put playground equipment on the park. <br />39 <br />40 Councilmember Reinert stated that with 300 or 400 children that would be living there, they are going <br />41 to need a park. He stated it's either dollars or land, and in this case it's land. He stated there have <br />42 been many cases where they've gotten land and had to figure out later how to build the park. He <br />43 stated he was confused on what the issue is here. <br />44 <br />45 City Planner Smyser told the Council that one of the problems the City has had historically is they've <br />46 been getting park land, but haven't had money to develop the park. He stated that most communities <br />47 don't get enough from developers for all of that and actually do use general fund monies or other <br />48 sources to augment what they get as park dedication from developers.
