COUNCIL MINUTES JULY 12, 2004 <br />APPROVED <br />241 <br />042 Community Development Director Grochala summarized the Staff report, indicating Staff <br />243 recommends approval of the rezoning and preliminary plat. <br />244 <br />245 Councilmember Carlson moved to approve the FIRST READING of Ordinance No. 18-04 rezoning <br />246 certain real estate from R -Rural to R -1X -Rural Executive for the Junes Addition. Councilmember <br />247 Dahl seconded the motion. <br />248 <br />249 Councilmember Carlson voted yea. Councilmember Dahl voted yea. Councilmember Stoltz voted <br />250 yea. Consideration of Resolution No. 04-94, Approving Preliminary Plat and MUSA <br />253 Allocation <br />254 <br />255 Councilmember Stoltz moved to adopt Resolution No. 04-94 approving a Preliminary Plat and the <br />256 allocation of 1.37 acres of MUSA Reserve for Junes Addition. Councilmember Dahl seconded the <br />257 motion. <br />258 <br />259 Motion carried unanimously. <br />260 <br />261 Resolution No. 04-94 can be found in the City Clerk's office. <br />262 <br />263 F. Consideration of Resolution No. 04-97, Approving Easement Acquisition, 62nd Street <br />1.264 Improvement Project, Jim Studenski <br />265 <br />266 City Engineer Studenski presented the Staff report, indicating Staff recommends approval. He <br />267 advised they believe they are down to one parcel left to negotiate, and if there are any changes to the <br />268 amount it would come back to the City Council. He advised they have started eminent domain <br />269 proceedings on all the parcels, so if agreement has not been reached by August 16th that will move <br />270 forward. He noted along 62nd Street there are areas with varying widths of right-of-way, and the City <br />271 was attempting to clean-up those situations, however the City feels they have prescriptive rights <br />272 because of maintenance done in those areas. He stated there is a challenge in one area to those rights. <br />273 <br />274 City Attorney Hawkins indicated he will provide a letter for Staff to address that property owner, and <br />275 Staff will provide a record of Public Works work that was completed. <br />276 <br />277 Councilmember Stoltz moved to adopt Resolution No. 04-96 approving acquisition of right -of - <br />278 way/easements for the 62h" Street Reconstruction Project.
