Consideration of Resolution No. 05-37, Approving Plans and Specifications, and <br />93 Authorizing Advertisement for Bids, Birch Street Trail Project, Rick DeGardner <br />94 <br />95 Public Service Director DeGardner summarized the Staff report, indicating Staff recommends <br />96 approval. <br />97 <br />98 Councilmember Carlson asked if funding for this came from Park Dedication fees, to which Public <br />99 Service Direction DeGardner indicated they did. <br />100 <br />101 Councilmember Dahl moved to adopt Resolution No. 05-37 Approving Plans and Specifications and <br />102 Authorizing Advertisement for Bids for Birch Street Trail Project. Consideration of Resolution No. 05-39, Approving Development Agreement, Turnberry <br />Abi 12 Crossing, Jim Studenski <br />13 <br />114 City Engineer Studenski summarized his report, indicating Staff recommends approval. <br />115 <br />116 Councilmember Dahl asked how the park dedication amount was derived, since the preliminary plat <br />117 was approved in September of 2004. City Engineer Studenski noted that for this development the fee <br />118 was a set amount of $25,000, since there were previous factors from previous portions of the project <br />119 that had an affect on the dollar amount. <br />120 <br />121 Councilmember Dahl asked when the new amount per unit became effective, and City Engineer <br />122 Studenski responded that it was 30 days after publication of the revised ordinance. He was unsure of <br />123 that exact date. <br />124 <br />125 Councilmember Reinert asked if the new rate only applies to new developments starting the approval <br />126 process, or if it would apply to cases already approved as well. City Engineer Studenski stated <br />127 anything coming to the City Council new in 2005 would use the new rate, and those developments <br />128 already in the process would be evaluated on a case-by-case basis to see how far they were in the <br />129 approval process when the rates were changed. <br />130 <br />131 Councilmember Reinert moved to adopt Resolution No. 05-39 approving the Development <br />132 Agreement for Turnberry Crossing.
