Consideration of Resolution No. 05-40, Approving Development Agreement, Highland 139 Meadows East 2"d Addition, Jim Studenski 140 141 City Engineer Studenski summarized his report, indicating Staff recommends approval. 142 143 The applicant, Steve Schmidt, stated he is seeing an assessment on individual units, however he 144 believes many of those should have been paid by the title company. He asked to have Staff re - 145 evaluate these fees. He also questioned the requirement of having roads and utilities completed 146 before building permits are issued. 147 148 City Engineer Studenski advised that as of last year, the City did implement the policy of having 149 certain portions of the roads and utilities completed before building permits are issued. He noted 150 there is an allowance for one model home per ten acres of development land so the builders can get 151 started selling. He noted this policy was changed because they had situations where the roads were 152 not ready, or temporary gas tanks were used because the utilities were not available, and they wanted 153 to avoid this type of situation. 154 155 Mr. Schmidt indicated he has no problem providing a guarantee that these things will get done, but he 156 has two kinds of buildings they will be using and would like to provide models of each this year. City 57 Engineer Studenski indicated Staff could work with the developer concerning the model home factor; IP58 however they do not want to get in the situation of having a lot of homes built before the other 159 elements are completed. He stated that concerning the assessments, Staff has reviewed the costs and 160 none were duplicated; however they can double check the records. 161 162 Councilmember Reinert moved to adopt Resolution No. 05-40 approving Development Agreement, 163 Highland Meadows East 2nd Addition. Councilmember Carlson seconded the motion. 164 165 Motion carried unanimously. 166 167 Resolution No. 05-40 can be found in the City Clerk's office. 168 169 C. Consideration of Resolution No. 05-41, Approving Development Agreement, Millers 170 Crossroads 2"d Addition, Jim Studenski 171 172 City Engineer Studenski summarized the Staff report, indicating Staff is recommending approval of 173 this request. 174 175 Councilmember Reinert asked if this addition is the same as previous additions in this development, 176 which he believes to be sub -standard. City Engineer Studenski stated this addition of the 177 development is the same as the previous additions. 178 �79 Councilmember Carlson moved to adopt Resolution No. 05-41 approving Development Agreement 180 for Millers Crossroads 2nd Addition. Councilmember Dahl seconded the motion. 4
