APPROVED <br />1 CITY OF LINO LAKES <br />2 MINUTES <br />3 <br />4 <br />5 DATE : April 25, 2005 <br />6 TIME STARTED : 6:32 P.M. <br />7 TIME ENDED : 7:32 P.M. <br />8 MEMBERS PRESENT : Councilmembers Carlson, Dahl, Reinert, Stoltz <br />9 and Mayor Bergeson <br />10 MEMBERS ABSENT : None <br />11 <br />12 Staff members present: City Administrator, Gordon Heitke; Community Development Director, <br />13 Michael Grochala; City Engineer, Jim Studenski; Assistant City Administrator; Dan Tesch (part); <br />14 City Attorney, Bill Hawkins; and City Clerk, Ann Blair. <br />15 <br />16 OPEN MIKE <br />17 <br />18 Mayor Bergeson requested Councilmember Stoltz chair this portion of the meeting, as it pertained to <br />19 the West Shadow Lake Drive discussion, from which he is abstaining. <br />20 <br />21 Councilmember Stoltz asked if there was anyone wishing to speak for the Open Mike portion of the <br />22 meeting. <br />23 <br />•24 Pat Smith, 6922 West Shadow Lake, indicated he has been a resident since 1981. He noted he has a <br />25 past history working with the city on various committees, and stated the reason for his visit was the <br />26 road construction for West Shadow Lake. He stated he and his fellow neighbors have put together a <br />27 petition asking that the feasibility study be done. He indicated he understands there is a cost issue, <br />28 but the condition of the road is not going away, and is not getting better. He stated there has been a <br />29 lot of misinformation about the street and he thinks the only way to clarify it is to do the feasibility <br />30 study. He noted the City has a charter that directs how this type of project is done, and the project <br />31 cannot get to a referendum for a vote without the feasibility study. <br />32 <br />33 Mr. Smith stated that 41 of the 61 homeowners affect signed the petition, noting he only had time to <br />34 go to 42 of the homes, and encountered only one homeowner who did not wish to sign the petition. <br />35 <br />36 Mr. Smith indicated he and several neighbors reviewed the tape from the last meeting to see the <br />37 concerns, but stated that no matter what the cost, it is their tax dollars, and the study needs to be done. <br />38 He commented that back in the 90's when he was on the Charter Commission they tried to get street <br />39 improvements off the Charter and into the hands of the elected officials unsuccessfully. He asked <br />40 what the process would be to get the feasibility study revisited. <br />41 <br />42 City Attorney Hawkins opined that the City Clerk would review the petition, and if adequate will <br />43 present it to the City Council for consideration at the next meeting. <br />44 <br />45 Mr. Smith indicated after watching the tape of the last meeting it is a mystery as to why this did not <br />46 go forward. He stated it is in the best interest of the residents. He questioned why some <br />dk 47 Councilmembers were opposed to the study. He stated the City Council needs to trigger the <br />Mir 48 feasibility study to see how much it will cost, and the rest of the process will run its course. <br />
