COUNCIL MINUTES APRIL 25, 2005 <br />APPROVED <br />49 <br />50 Councilmember Carlson commented that the question was asked two years ago on whether the Mayor <br />51 could or could not vote on this topic, so the opinion the Council just heard conflicts with previous <br />52 opinions. She reviewed previous Council meeting minutes in which the Mayor did participate. She <br />53 commented that when this issue came forward again she asked if anything different was being done to <br />54 help it pass, and noted she would consider the submission of a petition in future votes. She noted that <br />55 the need to change the Comprehensive Plan in this case is a factor for her, and she maintains that if <br />56 the Comprehensive Plan needs to change, it needs to go to the citizens for input, which has not been <br />57 done. <br />58 <br />59 City Attorney Hawkins noted that his advice to the Mayor was that he should not vote on this issue. <br />60 He stated the Mayor has a property that would benefit from this improvement, and may have a <br />61 financial gain. <br />62 <br />63 Councilmember Stoltz noted this is not a new position from Mayor Bergeson, and they do have a <br />64 written opinion from City Attorney Hawkins He stated that just prior to tonight's meeting Mayor <br />65 Bergeson informed him there were people in the audience from West Shadow Lake and he would <br />66 dismiss himself. He suggested they put this on the agenda as an information -only item to determine <br />67 what the next steps should be. <br />68 <br />69 Councilmember Carlson opposed adding it to the agenda, as it is not the process, and she is not <br />70 prepared to have dialogue on this topic. She also expressed concern about some Councilmembers <br />71 having a document from the City Attorney that other Council Members do not have. <br />•72 <br />73 Councilmember Reinert stated he would support an informational item being added to the agenda. <br />74 <br />75 Connie Dishdo, 7006 West Shadow Lake Drive, stated she has lived her since 1995. She indicated <br />76 this road poses a serious safety issue. She indicated that because of the trail system they are getting a <br />77 lot more traffic on West Shadow Lake, and when you have to go around the pedestrian and bike <br />78 traffic in your car it is dangerous. She stated everyone loves the trail system, but the road is used a lot <br />79 more than it used to be. <br />80 <br />81 Carl Loewecke, 6375 Painted Turtle Road, indicated he agrees with the previous speaker. He stated <br />82 he lives in the area, and he and his family go down to West Shadow Lake Drive a lot. He indicated <br />83 there is always a lot of pedestrian and bike traffic, and it is a narrow road. <br />84 <br />85 SETTING THE AGENDA <br />86 <br />87 Mayor Bergeson noted a student from an American Government Class at Centennial High School <br />88 who was in attendance. <br />89 <br />90 Councilmember Stoltz moved to add a process question under New Business, Item 8B, to understand <br />91 what the next steps are in the process for considering a feasibility study for West Shadow Lake Drive. <br />92 Councilmember Reinert seconded the motion. <br />93 <br />94 Councilmember Dahl stated she is curious on how this has been done in the past. She indicated that <br />95 typically when a topic has been raised at open mike they have had that person come to a work session <br />96 for further discussion. <br />2 <br />
