COUNCIL MINUTES JULY 11, 2005 <br />APPROVED <br />97 <br />•98 Councilmember Reinert moved to close the Public Hearing at 6:56 p.m. Councilmember Dahl <br />99 seconded the motion. <br />100 <br />101 Motion carried unanimously. Mayor Bergeson abstained. <br />102 <br />103 B. Public Hearing, West Shadow Lake Drive Street Improvement Project, Jim Studenski <br />104 <br />105 Mayor Bergeson requested that Councilmember Stoltz be Acting Mayor for this hearing also. <br />106 <br />107 City Engineer Studenski summarized the Staff report, indicating Staff recommends approval. <br />108 <br />109 Councilmember Reinert asked for an explanation of the concept of multiple assessments and increase <br />110 in property value with the ability to subdivide. City Engineer Studenski stated street policies are set <br />111 at $77 per foot on an individual lot basis so if the property can subdivide there would be multiple <br />112 assessments. He noted water and sewer costs are in alignment with other previous projects. <br />113 Assessments total $20,000 to $23,000 and are within the realm of other areas. Values increase when <br />114 the property can be subdivided and this increase would be significantly more than the assessments. <br />115 <br />116 Councilmember Carlson noted the lot owned by the independent school district is assessed for 11 <br />117 units and asked if the school plans to build, and, if not, would they be assessed for one property. City <br />118 Engineer Studenski stated the school has contacted the City and they do not plan to build because <br />119 they are turning the lot into a soccer field and other play areas. <br />120 <br />�21 Community Development Director Grochala stated the lot question is further down the plan process. <br />122 He noted for purposes of the south side of West Shadow Lake Drive, elimination of sanitary sewer <br />123 would not reduce their amount and it provides value and the ability to subdivide. He noted at the <br />124 public hearing, numbers can go lower but not higher. <br />125 <br />126 Councilmember Carlson asked where additional funds would be taken from. Community <br />127 Development Director Grochala stated the property tax levy would offset the amount. He noted if the <br />128 number of units were reduced the City would have to pick up a greater share of the street construction <br />129 costs, but pulling out water and sewer is a shared cost. <br />130 <br />131 City Engineer Studenski stated there are two separate sanitary/sewer systems and because the school <br />132 may not subdivide on the south side this may not happen. <br />133 <br />134 Councilmember Carlson asked if the sewer on the south side is eliminated what would happen to the <br />135 seven lots in the development north of the school; would the streets still be put in. She also asked if <br />136 the parcel could only hold seven lots in the development due to the wetlands, and if this number were <br />137 exceeded but seven lots were assessed, would it be possible to collect for more lots in the future. City <br />138 Engineer Studenski stated the number of lots would be a decision for the City. He noted the sewer <br />139 would not go down the street and property assessments would change from seven to one. He noted <br />140 the property is a long and narrow 10 -acre parcel and in the absence of several variances for lot width <br />141 requirements there is not enough land to get more full residential lots. <br />142 <br />143 Community Development Director Grochala stated the City could only collect for the number of lots <br />.44 that is on the plan tonight. He noted if they were able to get more lots in they would have to extend <br />3 <br />
