City Engineer Studenski stated it was the <br />.194 City's intention to equalize the impact of everyone, although there would be different perceptions of <br />195 what is currently out there. He noted the roadway does meander from one right-of-way to the other <br />196 but they used the full right-of-way with the standard equations. He noted there are no street <br />197 improvements closer to the property line due to what side a resident resides in. <br />198 <br />199 Community Development Director Grochala stated this is not typically done but if Council wishes the <br />200 City Attorney could draft a cover letter. <br />201 <br />202 Acting Mayor Stoltz stated Council can send the letter and it should go to the Shenandoah Area, too. <br />203 City Attorney Hawkins stated he could recite parts of the charter and what the resident's rights are. <br />204 <br />205 Jeff Mackie, 6829 West Shadow Lake Drive, stated the neighborhood does not need the bike path and <br />206 asked if it would alter the nature of the street if it is installed. He expressed concerns about <br />207 discrepancies on the plans, and noted it is hard to contain water with such a small curb. He <br />208 referenced Black Duck Road, stating the street is 32 feet wide with a 1 -foot surmountable curb. He <br />209 also noted the City's method of assessment is troubling, stating the assessment should be per foot of <br />210 frontage, and he is against the plan if assessed the way proposed. <br />211 <br />212 Joe Meyer, 6988 West Shadow Lake Drive, stated although there are a few naysayers it is a unique <br />213 neighborhood with small and large lots, and 80 to 90 percent of lake residents want the road and <br />214 water and sewer. Non -lake residents also want the road and do not really need the water and sewer, <br />215 but will take it. He noted he has concerns about how it would be placed on the ballot, if it would be <br />216 the Shenandoah Area and West Shadow Lake Drive separately or, as he would like to see it - <br />17 bundled. He concluded the City needs to figure out the best way for all residents to be served. <br />218 <br />219 Mike Trehus, 675 Shadow Court, stated there is a defect in the notification process because he did not <br />220 receive notice of the neighborhood meeting this weekend nor did three out of four residents on <br />221 Shadow Court. He stated 20-25 residents attending the meeting is not a good turnout considering the <br />222 potential change. He commented the project is tied together and asked if it is possible to petition <br />223 against a portion of the project, like the bike trail and, if so, would the City be required to honor the <br />224 charter. City Attorney Hawkins stated a portion of the project could be petitioned against and noted <br />225 per the charter the petition percentage is 50 percent or more. <br />226 <br />227 Mr. Trehus questioned charging for grinder pumps stating those who have good wells may want <br />228 sewer, but not water. He expressed concern about the longevity of the pump being proposed versus a <br />229 gravity sewer. He stated the trail is a dangerous design because when the road curves people have to <br />230 ride on the street. He asked where the ponds would be located, and if someone receives two lot <br />231 charges could they subdivide immediately or would they have to wait. Community Development <br />232 Director Grochala stated there needs to be a comprehensive plan amendment, and those provisions <br />233 need to be made before the project is adopted. He stated they are not adopting assessments today, <br />234 only holding a public hearing which proposes a maximum assessment amount. He noted actual <br />235 adoption would not happen until 2007 assuming the project is not petitioned against. <br />236 <br />237 Nick Aloff, Planner, Anoka County Parks, stated the section of proposed street improvements impact <br />238 the regional trail and he would like to see this move forward. <br />239 <br />• <br />5 <br />
