COUNCIL MINUTES JULY 11, 2005 <br />APPROVED <br />240 Joe Meyer, 6988 West Shadow Lake Drive, stated his view is that the citizens want a bike trail. He <br />2241 noted it is not going to impact the neighborhood very much and he considers it an enhancement. <br />42 <br />243 Jeff Mackie, 6829 West Shadow Lake Drive, stated this project does not impact Mr. Meyer because <br />244 he lives on the lake. He noted where he lives the street is the most narrow. He stated this project <br />245 creates animosity between lake owners and non -lake owners and it comes back to how the areas are <br />246 assessed although everyone's property would increase in value. <br />247 <br />248 Mike Trehus, 675 Shadow Court, again asked if all residents were aware of the grinder pump <br />249 situation noting they are different then a standard sewer. City Engineer Studenski stated there has <br />250 been a great deal of time spent on this issue. <br />251 <br />252 Charles Puskas, 6994 West Shadow Lake Drive, asked if the cost would be assessed over 15 years. <br />253 City Engineer Studenski stated that is correct. <br />254 <br />255 Councilmember Carlson stated there are a number of unanswered questions but some could be <br />256 answered by postponing closing the public hearing for two weeks. She noted the road was not <br />257 standard and asked why the road needs to be 32 feet wide. She suggested a motion be made to <br />258 include providing information to residents rather than adding this issue to New Business. Community <br />259 Development Director Grochala stated they are proposing the road be a standard minimum of 28 feet. <br />260 <br />261 Councilmember Reinert stated when roads are reconstructed, home rule City charter dictates it be <br />262 taken out of the City Council's hands and put in the citizen's hands. He noted there is confusion <br />263 regarding wording of the referendum, lot splitting and how it benefits property owners, and there are <br />many unanswered questions. He stated the City needs to communicate and educate affected property <br />•64 65 owners so they can get involved with the process. <br />266 <br />267 Councilmember Dahl stated there are questions about a petition against the trail and asked when <br />268 residents would need to submit this. Community Development Director Grochala stated the petition <br />269 would need to be submitted before the trail is built. Or, the petition could be submitted prior to the <br />270 referendum so it is not placed on the referendum. He noted it is not being assessed so the petitioning <br />271 process would not dictate the trail. <br />272 <br />273 Councilmember Dahl stated she is concerned about closing the hearing because some residents stated <br />274 they were not notified and did not participate in neighborhood meetings. Community Development <br />275 Director Grochala stated they would review the mailing list, but failure to receive notice does not alter <br />276 the project. <br />277 <br />278 Councilmember Dahl stated she is concerned because a grinder pump is needed which is different <br />279 than other road projects. She stated they do have a home rule charter and residents vote on road <br />280 issues; the power is with the people. <br />281 <br />282 Acting Mayor Stoltz stated the home rule charter is a double-edged sword; it wants to give <br />283 responsibility to the citizens yet wants to make them engineers. <br />284 <br />285 Councilmember Dahl moved to extend the public hearing until the next Council meeting. <br />286 Councilmember Carlson seconded the motion. <br />087 <br />6 <br />
