Consideration of Resolution No. 05-111, Accepting Plans and Specifications and <br />195 Authorizing Advertisement for Bids, 2005 Surface Water Management Project, Jim <br />196 Studenski <br />197 <br />198 City Engineer Studenski summarized the Staff report, indicating Staff recommends approval. <br />199 <br />200 Councilmember Carlson moved to adopt Resolution No. 05-111, Accepting Plans and Specifications <br />201 and Authorizing Advertisement for Bids, 2005 Surface Water Management Project. Councilmember <br />202 Dahl seconded the motion. <br />203 <br />204 Motion carried unanimously. <br />205 <br />206 Resolution No. 05-111 can be found in the City Clerk's office. <br />207 <br />208 C. Consideration of Resolution No. 05-113, Authorization to Acquire Certain Real Property <br />221 for Utility Purposes, County State Aid Highway 14/8 Reconstruction Project, Michael <br />222 Grochala <br />223 <br />224 Community Development Director Grochala summarized the Staff report, indicating Staff <br />225 recommends approval. <br />226 <br />227 Councilmember Carlson asked if voting to approve binds the price and if the price is not accepted is it <br />228 possible to negotiate. Community Development Director Grochala replied this is the price the City is <br />229 offering and if not accepted the owner could counteroffer or it would go to court for a condemnation <br />230 price. <br />231 <br />232 Councilmember Dahl moved to adopt Resolution No. 05-113, Authorization to Acquire Certain Real <br />233 Property for Utility Purposes, County State Aid Highway 14/8 Reconstruction Project. <br />234 Councilmember Stoltz seconded the motion. <br />235 <br />236 Councilmember Carlson stated she would vote to approve; however, has concern for the property <br />237 owner's rights and hopes legal action is not necessary. <br />238 <br />0239 Motion carried unanimously. <br />5 <br />
