• <br />1 COUNCIL MINUTES MAY 22, 2006 <br />APPROVED <br />reading of Ordinance 07-06 on May 8, 2006. The ordinance amends the City's fee schedule by <br />adding a special development fee to be charged for new development in the area studied by the I -35E <br />corridor AUAR. The fee is intended to recoup the City's costs for preparing the AUAR. <br />Councilmember Reinert moved to approve Second Reading and adoption of Ordinance No. 07-06, as <br />presented. Councilmember Carlson seconded the motion. <br />A roll call vote was taken: four yeas and zero nays. Motion carried unanimously. <br />PUBLIC HEARING: Consider Ordinance 06-06, Vacating a Portion of North Road and <br />Sunrise Drive, Michael Grochala — Community Development Director Grochala stated the City of <br />Lino Lakes has initiated a vacation by the recently unused rights of way dedicated as party of <br />Lexington Park Lake View, further defined by the recently approved Registered Land Survey No. 233 <br />as Tracts F and G. This vacation will revert the property to the adjacent parcels of Lexington Park <br />Lake View and further defined by the Registered Land Survey No. 233 as Tracts D and I. <br />Community Development Director Grochala advised these rights of way are no longer improved <br />because of the realignment of North Road and Lake Drive. Therefore, there is no reason to hold onto <br />the right of way that is no longer improved. <br />Mayor Bergeson opened the public hearing at 7:10 p.m. <br />• Councilmember Reinert moved to close the public hearing at 7:10 p.m. Councilmember O'Donnell <br />seconded the motion. Motion carried unanimously. <br />• <br />Councilmember Carlson moved to approve First Reading of Ordinance No. 06-06, as presented. <br />Councilmember O'Donnell seconded the motion. <br />A roll call vote was taken: four yeas and zero nays. Motion carried unanimously. <br />Consideration of Resolution No. 06-75, Accepting Storm Water Utility Feasibility Report, <br />Michael Grochala — Community Development Director Grochala stated on January 9, 2006 the City <br />Council authorized the preparation of a Storm Water Utility Feasibility Study. The intent of the study <br />is to identify a funding source and equitable means of funding the City's storm water management <br />program. <br />Community Development Director Grochala advised a copy of the draft study prepared by Short, <br />Elliott, Hendrickson Inc., (SEH) was presented to the Council at the May 1, 2006 work session. He <br />noted the draft study includes three rate scenarios based on funding street reconstruction related storm <br />water costs at funding levels of 100%, 75% and 50%. <br />Community Development Director Grochala stated acceptance of the study does not establish or <br />otherwise commit the City to establishing a Storm Water Utility. <br />5 <br />
