COUNCIL MINUTES JUNE 26, 2006 APPROVED 90 Consider Resolution No. 06-101, Accepting Donation of $280 from the Ladies Auxiliary VFW • 91 Post #6583 for the School Patrol Appreciation Day Event, Chief Pecchia — Chief Pecchia advised 92 the Ladies Auxiliary VFW Post #6583 has donated $280.00 to the City of Lino Lakes to defray the 93 cost of bus transportation for the Rice Lake Elementary School Safety Patrol Program. 94 95 Council Member Reinert moved to adopt Resolution No. 06-101, as presented. Council Member 96 Stoltz seconded the motion. Motion carried unanimously. 97 98 PUBLIC SERVICES DEPARTMENT REPORT, RICK DEGARDNER 99 100 There was no report from the Public Service Department. 101 102 COMMUNITY DEVELOPMENT DEPARTMENT REPORT, MICHAEL GROCHALA 103 104 Lois Lane Utility Improvements: 105 106 Consideration of Resolution No. 06-100, Adopting Assessments, Jim Studenski — City Engineer 107 Studenski stated on May 22, 2006, the City Council set the Public Hearing for the proposed 108 assessments for the Lois Lane Utility Extension project. An ad was placed in the Quad Press and the 109 necessary notices have been mailed to property owners indicating the amount of the assessment and 110 the date of the hearing. 111 012 City Engineer Studenski advised the project is 100% assessed to the benefited property owners. The 113 City will be assessing $186,571.70 at this time. The remaining $209,190.80 has been deferred and 114 will be assessed at the time of the future connection. Project costs are as projected in the feasibility 115 report at a total cost of $395,762.50. 116 117 City Engineer Studenski stated the City did receive two letters challenging the assessment. Ms. 118 Tiffany Borsheim at 554 Lois Lane and Mr. and Mrs. Leavell at 511 Lois Lane have submitted letters 119 objecting to the proposed City assessment for utilities. He noted residents could appeal if the 120 assessment roll is adopted by the City Council. 121 122 City Engineer Studenski clarified the City policy regarding projects that are initiated by residents as 123 opposed to project that are initiated by the City. Assessments are not deferred when the residents 124 initiate projects. The City is only assessing for one utility on each lot at this time. Properties will be 125 assessed for another lot when they choose to subdivide. 126 127 Council Member Reinert moved to open the public hearing at 6:48 p.m. Council Member Stoltz 128 seconded the motion. Motion carried unanimously. 129 130 Ms. Tiffany Borsheim, 554 Lois Lane, came forward and read her letter objecting to the proposed 131 City assessment. She outlined her reason for objecting and asked that her mound and well systems be 132 grandfathered in. She also requested that the existing house at 554 Lois Lane is not assessed for the 133 City sanitation and water services until the current mound system fails. Also in her request, she asked .34 to include that even if the property of 554 Lois Lane were split into two lots, the new lot would be 3
