1 COUNCIL MINUTES JUNE 26, 2006 <br />APPROVED <br />135 required to connect to the City sanitation and water services and would be assessed for those costs. In <br />1.136 addition, if the property were split into two lots, the existing house at 554 Lois Lane would be not <br />137 required to hook up to the City services nor would it be assessed until the current mound or well <br />138 system fails. <br />139 <br />140 City Attorney Hawkins stated it is very common to have different types of systems on different lots. <br />141 The City does have the ability to assess as long as the assessed amount does not exceed the benefit in <br />142 terms of market value. The City has to treat all residents the same and the project does have to be <br />143 paid for. Residents do have the right to appeal the estimated benefit of the City services. <br />144 <br />145 Mr. Tim Anderson, 547 Lois Lane, came forward and stated residents in this area were told they <br />146 would be able to hook up to City services and subdivide when Bluebill Ponds was developed. He <br />147 indicated he is supportive of the project and stated it makes economic sense to do this project. He <br />148 noted his neighbors, Mr. and Mrs. Flanagan, 535 Lois Lane, could not be present this evening but <br />149 would like to pass on their recommendation to move forward with the project. <br />150 <br />151 Council Member Stoltz moved to close the public hearing at 6:58 p.m. Council Member Carlson <br />152 seconded the motion. Motion carried unanimously. <br />153 <br />154 Council Member Stoltz moved to adopt Resolution No. 06-100, as presented. Council Member <br />155 Carlson seconded the motion. Motion carried unanimously. <br />156 <br />0157 Consideration of Resolution No. 06-89, Awarding Contract, Jim Studenski — City Engineer <br />158 Studenski advised sealed bids were received and publicly opened at 2:00 p.m. on May 15, 2006. He <br />159 reviewed the results of the bid opening noting the public hearings regarding the project and the <br />160 assessments have been held. <br />161 <br />162 City Engineer Studenski stated the low bid is approximately 19% under the Engineer's Estimate for <br />163 the project. The low bid was submitted from Jay Bros. Inc. in the amount of $186,408.30. The final <br />164 completion date for this project is August 23, 2006. <br />165 <br />166 Council Member Carlson moved to adopt Resolution No. 06-89, as presented. Council Member <br />167 Reinert seconded the motion. Motion carried unanimously. <br />168 <br />169 Consideration of Resolution No. 06-102, Accepting Bids and Awarding Contract, 2006 Birch <br />170 Street Trail, Jim Studenski — City Engineer Studenski advised sealed bids were received and <br />171 publicly opened at 10:00 a.m. on June 20, 2006. He reviewed the results of the bid opening noting <br />172 the low bid is approximately 6% above the Engineer's Estimate. The low bid was submitted from TA <br />173 Schifsky & Sons Inc. in the amount of $149,045.00. The final completion date for this project is <br />174 August 25, 2006. <br />175 <br />176 Council Member Reinert moved to adopt Resolution No. 06-102, as presented.
