COUNCIL MINUTES DECEMBER 18, 2006 <br />APPROVED <br />41) 1 Development Director Grochala stated the Assignment and Release includes a provision that extends <br />2 the Timeline for Commencement and Construction of the project. The new provisions require that <br />3 construction must commence by January 15, 2007 and be completed by April 15, 2008. <br />4 <br />5 Mayor Bergeson moved to approve Resolution No. 06-196, as presented. Council Member <br />6 O'Donnell seconded the motion. Motion carried unanimously. <br />7 <br />8 Consideration of Resolution No. 06-214, Approving Extension of Metropolitan Council Grant <br />9 Agreement and Loan to LLAH Limited Partnership, Michael Grochala — Community <br />10 Development Director Grochala advised the City of Lino Lakes obtained a $225,000 grant under the <br />11 Livable Communities Act Local Housing Incentives Account on December 16, 2004 for the purpose <br />12 of helping to finance Lakewood Apartments in the Legacy at Woods Edge Project. The grant <br />13 agreement has an expiration of December 31, 2006. <br />14 <br />15 Community Development Director Grochala stated Hartford Group and LLAH Limited Partnership <br />16 are expected to close on the financing of the property in late December and begin construction shortly <br />17 thereafter. Due to delay in the start of construction, the Metropolitan Council has agreed to extend <br />18 the grant for one year upon approval by the City Council. <br />19 <br />20 Community Development Director Grochala stated the developer has requested, in order to facilitate <br />21 their financing, that the grant be provided in the form of a 30 -year interest free loan. The grant <br />22 agreement authorizes the City to use grant funds to make deferred loans. Because the EDA is the <br />23 administrator of Development District NO. 1 in which this project will occur, legal counsel has <br />24 advised that the EDA is the appropriate authority to provide this loan. <br />25 <br />26 Council Member Stoltz moved to approve Resolution No. 06-214, as presented. Council Member <br />27 Reinert seconded the motion. Motion carried unanimously. <br />28 <br />29 Consideration of Resolution No. 06-216, Approving Change Order No. 2, Legacy at Woods <br />30 Edge, Phase II, Street Lighting Project, Michael Grochala — Community Development Director <br />31 Grochala advised on April 24, 2006 the City Council awarded the Legacy at Woods Edge Phase 2 - <br />32 Streetlighting Improvements contract to W.H. Response. The current approved contract amount, <br />33 including construction ($486,200.84) and 15 -year maintenance agreement ($145,800.00) is <br />34 $632,000.84. <br />35 <br />36 Community Development Director Grochala stated the installed lighting system would be extended <br />37 along Lake Drive from Town Center Parkway to Apollo Drive in conjunction with the Lake Drive <br />38 improvement project. Twenty lights are proposed to be installed on the east side of the road adjacent <br />39 to the new trail. <br />40 <br />41 Community Development Director Grochala advised W.H. Response has proposed to complete the <br />42 work in accordance with the existing unit prices including the cost per unit for the 15 -year <br />43 maintenance agreement. The total for Change Order No. 2 is in the amount of $132,737.07. The total <br />.44 revised contract amount, with the change order is $764,737.91. The change order represents a 21% <br />45 increase in the contract amount. Change orders cannot exceed 25% of the original contract amount. <br />6 <br />
