Council <br />100 Member Carlson seconded the motion. Motion carried unanimously. <br />101 <br />102 PUBLIC SAFETY DEPARTMENT REPORT, DAVE PECCHIA <br />103 <br />104 There was no report from the Public Safety Department. <br />105 <br />106 PUBLIC SERVICES DEPARTMENT REPORT, RICK DEGARDNER <br />107 <br />108 There was no report from the Public Services Department. <br />109 <br />110 COMMUNITY DEVELOPMENT DEPARTMENT REPORT, MICHAEL GROCHALA <br />111 <br />112 Consideration of Ordinance No. 04-07, vacating a portion of the drainage and utility easements <br />113 on Lots 6 and 7 of the recorded plat Oakwood View and accepting a new drainage and utility <br />114 easement — Associate Planner Bengtson reported that the developer of this site, that was previously <br />115 approved and is under development, is requesting an adjustment of the lot lines to allow a specific <br />116 type of home to be constructed on the larger of the two lots. All city requirements are met for the <br />117 change. <br />•18 <br />119 The public hearing was opened. There was no one present wishing to speak. <br />120 <br />121 Council Member Carlson moved to close the public hearing at 6:58 p.m. Council Member O'Donnell <br />122 seconded the motion. Motion carried unanimously. <br />123 <br />124 Council Member Reinert moved to approve First Reading of Ordinance No. 04-07, as presented. <br />125 Council Member Stoltz seconded the motion. <br />126 <br />127 A roll call vote was taken: five yeas and zero nays. Motion carried unanimously. <br />128 <br />129 Consideration of Ordinance No. 05-07, rezoning the property at 554 Lois Lane from R (Rural) <br />130 to R-1 (Single Family Residential) and Cox Estates - Associate Planner Bengtson explained that <br />131 the request involves lots on Lois Lane that would be divided for development. They meet city <br />132 requirements but would require a zoning change from rural to single family. The lots fall within the <br />133 growth management plan and park dedication is included. Staff recommends approval of the request <br />134 for rezoning and preliminary plat. <br />135 <br />136 Council Member O'Donnell moved to approve First Reading of Ordinance No. 05-07, as presented. <br />137 Council Member Stoltz seconded the motion. <br />138 <br />S139 A roll call vote was taken: five yeas and zero nays.
