COUNCIL MINUTES April 23, 2007 APPROVED 95 Consideration of Resolution No. 07-54, Approving summary publication of Ordinance No. 03- •96 07 - Administrator Heitke explained that a resolution including and authorizing a summary 97 publication of Ordinance No. 03-07 is being presented for approval. 98 99 Council Member O'Donnell moved to approved Resolution No. 07-54, as presented. Council 100 Member Carlson seconded the motion. Motion carried unanimously. 101 102 PUBLIC SAFETY DEPARTMENT REPORT, DAVE PECCHIA 103 104 There was no report from the Public Safety Department. 105 106 PUBLIC SERVICES DEPARTMENT REPORT, RICK DEGARDNER 107 108 There was no report from the Public Services Department. 109 110 COMMUNITY DEVELOPMENT DEPARTMENT REPORT, MICHAEL GROCHALA 111 112 Consideration of Ordinance No. 04-07, vacating a portion of the drainage and utility easements 113 on Lots 6 and 7 of the recorded plat Oakwood View and accepting a new drainage and utility 114 easement — Associate Planner Bengtson reported that the developer of this site, that was previously 115 approved and is under development, is requesting an adjustment of the lot lines to allow a specific 116 type of home to be constructed on the larger of the two lots. All city requirements are met for the 117 change. •18 119 The public hearing was opened. There was no one present wishing to speak. 120 121 Council Member Carlson moved to close the public hearing at 6:58 p.m. Council Member O'Donnell 122 seconded the motion. Motion carried unanimously. 123 124 Council Member Reinert moved to approve First Reading of Ordinance No. 04-07, as presented. 125 Council Member Stoltz seconded the motion. 126 127 A roll call vote was taken: five yeas and zero nays. Motion carried unanimously. 128 129 Consideration of Ordinance No. 05-07, rezoning the property at 554 Lois Lane from R (Rural) 130 to R-1 (Single Family Residential) and Cox Estates - Associate Planner Bengtson explained that 131 the request involves lots on Lois Lane that would be divided for development. They meet city 132 requirements but would require a zoning change from rural to single family. The lots fall within the 133 growth management plan and park dedication is included. Staff recommends approval of the request 134 for rezoning and preliminary plat. 135 136 Council Member O'Donnell moved to approve First Reading of Ordinance No. 05-07, as presented. 137 Council Member Stoltz seconded the motion. 138 S139 A roll call vote was taken: five yeas and zero nays. Motion carried unanimously. 140 3
