Consider 1st Reading of Ordinance No. 17-07, Vacating a portion of the <br />139 drainage and utility easement on Lot 16 Block 4 of the recorded plat Park Grove <br />140 <br />141 Since an inadequate number of council members were present to approve the ordinance, the <br />142 council opted to postpone consideration except that the public hearing would be opened and <br />143 continued. <br />144 <br />145 Mayor Bergeson opened the public hearing at 7:30 p.m. There was no one present wishing to <br />146 speak. <br />147 <br />148 Council Member Gallup moved that the public hearing be continued to January 28, 2008. <br />149 <br />150 Marshan Meadows 2"d Addition <br />151 - Resolution No. 08-07, Approving Preliminary Plat, Marshan Meadows 2"d Addition; <br />152 - Resolution No. 08-05, Approving Development Agreement for Marshan Meadows 2nd <br />153 Addition; <br />154 Resolution No. 08-08, Approving Final Plat for Marshan Meadows 2nd Addition, Paul <br />155 Bengtson <br />156 <br />157 City Planner Bengtson noted that Bruggeman Homes has requested approval of a two lot <br />158 residential subdivision to be known as Marshan Meadows 2"d Addition. A report outlining a <br />159 proposed preliminary plan, development agreement and final plan was presented. Staff is <br />•60 recommending approval of the project with conditions noted in the report except that condition <br />161 number six should be removed. <br />162 Staff will also correct a discrepancy in the development agreement regarding the developer's <br />163 deposit; it should read that 35% of the total estimated cost of city improvements is required. <br />164 <br />165 Council Member Stoltz moved to approve Resolution Nos. 08-07, 08-05, and 08-08 as presented <br />166 and corrected. Council Member Gallup seconded the motion. Motion carried. <br />167 <br />168 Resolution No. 08-10, Accepting Land Donation, Outlot A, Woodridge Estates and Outlot B, <br />169 Woodridge Estates — City Planner Smyser explained that the developer of the Woodridge Estates <br />170 neighborhood wishes to donate two wetland outlots that are landlocked and usable for development. <br />171 Staff recommends that the city accept the donation. <br />172 <br />173 Council Member Gallup moved to approve Resolution No. 08-10 as presented. Council Member <br />174 Stoltz seconded the motion. Motion carried. <br />175 <br />176 Resolution No. 08-04, Approving Final Payment, 2007 Street Overlay Project — City Engineer <br />177 Studenski reported that the 2007 Overlay project has been satisfactorily completed and staff is <br />178 recommending final payment to the contractor, WB Miller, Inc. <br />179 <br />180 Council Member Stoltz moved to approve Resolution No. 08-04 as presented.
