acre, the developer has the right to develop at a density consistent with the original PUD. <br />The increased density to 3.76 units per acre moves in a direction more consist with the <br />current Comprehensive Plan. <br />PUD Final Plan/Final Plat <br />Subdivision Ordinance <br />Conformity with the Comprehensive Plan and Zoning Code <br />The PUD Final Plan/Final Plat has been reviewed for compliance with the comprehensive <br />plan, zoning and subdivision ordinance. The proposed development is not considered <br />premature and meets the performance standards of the subdivision and zoning ordinance. <br />Resolution 14-43 approved the PUD Development Stage Plan/Preliminary Plat with <br />conditions required prior to approval of the PUD Final Plan/Final Plat. The conditions <br />have been satisfied unless otherwise noted in this report. <br />As noted in the July 28, 2014 Council Staff Report, the PUD Preliminary Plat <br />Amendment was scheduled to be approved at the June 9, 2014 City Council meeting; <br />however, the developer requested three (3) single family lots be removed from the <br />proposed preliminary plat. Consequently, no parkland needs to be vacated as previously <br />proposed. Staff determined the request reasonable and it did not require review again by <br />the Planning & Zoning Board. The final plat is consistent with the amended preliminary <br />plat. <br />Blocks and Lots <br />The final plat creates 29 lots and 3 outlots. Outlot A is a wetland. Outlot B is a <br />stormwater management facility. Outlot C is for future townhome development. <br />Easements <br />Standard drainage and utility easements are being dedicated on individual lots and over <br />stormwater management facilities. Twenty foot wide drainage and utility easements are <br />shown along the rear lot lines for storm water management. <br />Conservation easements will also be dedicated over Outlots A & B for protection of the <br />wetlands and wetland buffers. <br />Street and Utilities <br />In July 2014, the developer signed a Petition and Waiver Agreement for road <br />construction, utility extension and right-of-way dedication for Robinson Drive. The <br />Agreement authorized the City Engineer to prepare plans and specifications for the <br />improvements and allowed the City to levy construction improvement costs against the <br />property. <br />al <br />
