AGENDA ITEM 8A <br />STAFF ORIGINATOR: Michael Grochala <br />COUNCIL MEETING DATE: July 11, 2011 <br />TOPIC: i. Ordinance No. 16-11, Amending <br />City Code by Adding the Minnesota <br />Electrical Act to City Code <br />ii. Resolution No. 11-74 Authorizing <br />Execution of Professional Services <br />Agreement with David Kichler Inspections. <br />ACTION REQUIRED: Simple Majority <br />BACKGROUND: <br />The lack of an adopted state budget in 2011 has resulted in a temporary suspension of <br />many state functions. One of these directly effecting Lino Lakes is the suspension of <br />electrical inspections. Under state law, any new electrical installations in virtually any <br />construction, remodeling, replacement or repair must be inspected for compliance with <br />accepted standards of construction for safety to life and property. Due to the state <br />shutdown current construction projects may be delayed due to the suspension of <br />inspections. <br />To avoid this possibility the City may enact an emergency ordinance to establish an <br />electrical inspection program administered by the City. Ordinance 16-11 is being proposed <br />for this purpose until such time as a state budget is enacted and services are resumed. <br />Under this proposal electrical inspection would be provided under contract by David <br />Kichler Inspections. Mr. Kichler is currently providing services to Lino Lakes as a <br />contractor with the State and also provides electrical inspection services on a contract <br />basis to neighboring cities including Hugo and Centerville. <br />Due to the lack of inspection services Ordinance 17-11 is considered an emergency <br />ordinance under the provisions of the City Charter. Accordingly the ordinance will go <br />into effect immediately upon passage. <br />RECOMMENDATION: <br />Staff is recommending approval of Ordinance No. 17-11 and Resolution No. 11-74. <br />ATTACHMENTS <br />1.
