�il�ti-,6u�Z Ion��luaat� - e-f[e( Lie_ jOlio120Ni <br />Council Member Stoltz moved for adoption of the following ordinance: <br />CITY OF LINO LAKES <br />ORDINANCE NO. 10-06 <br />APPROVING REZONING OF PROPERTY AT THE SOUTHEAST CORNER OF <br />BIRCH STREET AND HODGSON ROAD <br />FROM LB LIMITED BUSINESS TO NB NEIGHBORHOOD BUSINESS <br />The City Council of the City of Lino Lakes, Anoka County, Minnesota does ordain: <br />Section 1: Findings <br />The City Council makes the following findings regarding rezoning the property described <br />below, based on the factors listed in Section 2 of the Lino Lakes zoning ordinance: <br />1. The City Council may from time to time amend the Zoning Ordinance as allowed by <br />state statute and city ordinance. <br />2. The LB Limited Business is not the appropriate zoning for the commercial site at the <br />southeast corner of Birch St. and Hodgson Rd. because of several auto -oriented uses <br />allowed in a LB zone and their potential negative impacts on the surrounding <br />residential neighborhood. Such auto -oriented uses are not allowed in a NB <br />Neighborhood Business zone. <br />3. The City Council adopted Ordinance No. 09-06 amending uses in the three business <br />zones. <br />4. The proposed action has been considered in relation to the specific policies and <br />provisions of and has been found to be consistent with the official City <br />Comprehensive Plan. <br />a. The comprehensive plan guides the site for Commercial land use. Neighborhood <br />Business is one of the zoning districts intended for areas so designated. <br />b. The site is within the existing Metropolitan Urban Service Area. <br />5. The uses allowed in the Neighborhood Business zone are more compatible with <br />present and future land uses of the area than uses in the Limited Business zone. <br />6. All use of the site will be required to conform with applicable performance standards. <br />7. Proposed uses will be required to be accommodated with existing public services and <br />not overburden the City's service capacity. Municipal water and sanitary sewer are <br />available to the site and sufficient capacity exists. <br />
