CITY OF LINO LAKES <br /> ORDINANCE NO. 01-02 <br /> ORDINANCE ACCEPTING A PERMANENT DRAINAGE EASEMENT AND <br /> VACATING PART OF AN EXISTING DRAINAGE AND UTILITY EASEMENT <br /> ON LOT 1,BLOCK 10, LAKES ADDITION NO. 3 <br /> THE CITY COUNCIL OF THE CITY OF LINO LAKES DOES HEREBY ORDAIN: <br /> Section 1 <br /> The City Council makes the following findings: <br /> 1. The Lakes Addition No. 3 plat was approved by the Village of Lino Lakes in 1973. <br /> Utility and drainage easements around the lot perimeters, 10 feet wide,were <br /> dedicated and recorded as part of that plat. <br /> 2. On March 27, 1989, the Lino Lakes City Council granted an"easement variance" and <br /> vacation of a portion of an easement on Lot 1, Block 10, Lakes Addition No. 3 to <br /> allow a house to be built closer to the lot lines than would be allowed by the <br /> easements around the perimeter of the lot (Attachment A). No easement vacation was <br /> ever recorded. <br /> 3. A house has been built within the existing 10' easements. <br /> 4. It is necessary to vacate a portion of the existing 10' easements to finalize the action <br /> taken in 1989 but never recorded. <br /> 5. A separate drainage and utility easement was to be dedicated in 1999 covering the <br /> southeastern portion of Lot 1, Block 10. This easement was not recorded. <br /> 6. The City has received an new document dedicating this easement to the City <br /> (Attachment B). It is necessary to accept this easement and record it. <br />
