CITY OF LINO LAKES <br />ORDINANCE NO. 11-02 <br />AN ORDINANCE GRANTING A FRANCHISE TO MEDIAONE NORTH CENTRAL <br />COMMUNICATIONS CORP., D/B/A AT & T BROADBAND, TO CONSTRUCT, <br />OPERATE <br />AND MAINTAIN A CABLE SYSTEM IN THE CITY OF LINO LAKES, MINNESOTA, <br />FOR THE PURPOSE OF PROVIDING CABLE SERVICE; SETTING FORTH <br />CONDITIONS ACCOMPANYING THE GRANT OF THE FRANCHISE; PROVIDING <br />FOR REGULATION AND USE OF THE SYSTEM AND THE PUBLIC RIGHTS-OF-WAY <br />IN CONJUNCTION WITH THE CITY'S RIGHT-OF-WAY ORDINANCE, IF ANY; AND <br />PRESCRIBING PENALTIES FOR THE VIOLATION OF THE PROVISIONS HEREIN. <br />WHEREAS, the City Council of Lino Lakes has determined to renew their Cable Franchise <br />Agreement with AT & T Broadband; and <br />WHEREAS, a public hearing and first reading was held on October 14, 2002 before the City <br />Council in the City Hall Council Chambers after duly published and posted notice was given, and; <br />WHEREAS, it appears to be in the best interests of the City to enter into this renewal agreement, <br />and; <br />WHEREAS, the City Council has concurred to publish a summary of the Ordinance in the following <br />format; <br />NOW, THEREFORE THE CITY COUNCIL OF LINO LAKES ORDAINS: <br />RENEWAL FRANCHISE ORDINANCE SUMMARY <br />On October 28, 2002, the City of Lino Lakes, Minnesota (the "City"), adopted on second <br />reading Ordinance No. 11-02, which grants a franchise to MediaOne North Central <br />Communications Corp. d/b/a AT&T Broadband. Among other things, Ordinance No. 11-02 <br />does: <br />*Permit AT&T Broadband to use the City's public rights-of-way to provide cable service to <br />subscribers in the City for a period of fifteen years from the effective date of the franchise; <br />•Require AT&T Broadband to comply with applicable federal, state and local law; <br />•Impose conditions on AT&T Broadband's use of City public rights-of-way; <br />•Obligate AT&T Broadband to follow all applicable safety practices required by law; <br />•Allow the City to use AT&T Broadband's poles, ducts and conduits, free of charge, for <br />noncommercial purposes; <br />
