CITY OF LINO LAKES <br />ORDINANCE NO. 05-03 <br />AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF <br />LINO LAKES BY REZONING CERTAIN REAL ESTATE FROM R -X, RURAL <br />EXECUTIVE TO R -X, RURAL EXECUTIVE/PDO, PLANNED DEVELOPMENT <br />OVERLAY DISTRICT <br />The City Council of the City of Lino Lakes, Anoka County, Minnesota does <br />ordain: <br />Section 1. The City Council makes the following findings regarding the <br />application for rezoning the property described below, based on the factors listed <br />in Section 2, Subd. 1.E. of the Lino Lakes zoning ordinance: <br />1. The proposed rezoning is consistent with the City's Comprehensive Plan. <br />The Plan provides for rural clustered subdivisions. The overall density of <br />the development (1 unit per 12.49 acres) is consistent with the minimum <br />rural development density of 1 per 10 acres as specified in the plan. The <br />proposal also allows for future sewered residential development. <br />2. The proposed use will be compatible with both present and future land <br />uses. The proposed subdivision is compatible with existing rural <br />residential uses and does not prevent possible future sewered residential <br />development. <br />3. The proposed subdivision, in conjunction with the conditions of preliminary <br />plat approval, will conform to the performance standards contained with <br />the zoning ordinance. <br />4. The proposed use will not overburden the City's service capacity. <br />5. Trip generation from the addition of two residential lots is within the <br />capabilities of existing streets serving the property subject to the <br />conditions of preliminary plat approval. <br />Section 2. A public hearing was held before the Planning & Zoning Board on <br />February 12, 2003. <br />Section 3. The Zoning Ordinance of the City of Lino Lakes, Anoka County, <br />Minnesota, passed by the City Council on July 14, 1997 is hereby amended by <br />rezoning from R -X, Rural Executive to R -X, Rural Executive/PDO, Planned <br />Development Overlay District the following described real estate: <br />5 <br />
